The court further held that certain decisions made by the Chief Executive and the Director were "wholly procedural" and not subject to review under the Administrative Decisions (Judicial Review) Act 1977 (Cth) (ADJR Act), as they were not decisions to which the ADJR Act applied. Finally, the court dismissed Dr Karmakar's application in its entirety.
