Terms of Service – CaseChat
These Terms of Service (“Terms”) govern your access to and use of CaseChat (“CaseChat”, “we”, “us”, or “our”). By creating an account, accessing, or using CaseChat, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use CaseChat.
1. Overview of the Service
CaseChat provides artificial intelligence (AI)–powered legal research tools designed to assist Australian barristers, solicitors, and law students. The platform generates responses grounded in legal texts, which are made available for research, study, reporting of judicial proceedings, and to support the provision of professional legal advice.
CaseChat is not a law firm and does not provide legal advice. We make no representations or warranties as to the accuracy or effectiveness of AI-generated responses. You are strongly encouraged to independently verify all outputs, including citations and underlying legal materials, against authoritative sources such as Commonwealth and State courts and government publications. While we strive for accuracy, you are solely responsible for verifying all information.
2. Eligibility
CaseChat is intended for use by individuals engaged in or studying Australian law.
To use CaseChat, you must:
- be at least 18 years old;
- have the legal capacity to enter into binding agreements; and
- comply with all applicable laws and professional obligations.
By using CaseChat, you represent and warrant that you meet these requirements.
3. Account Registration and Security
To access CaseChat, you must create an account. You agree to:
- provide accurate, current, and complete registration information;
- maintain the confidentiality of your login credentials;
- promptly notify us of any unauthorised access or suspected breach; and
- accept responsibility for all activity conducted under your account.
We reserve the right to suspend or terminate accounts that breach these Terms or pose a security risk.
4. Client Data
“Client Data” means any documents, text, queries, or other content you upload or input into CaseChat.
You are responsible for ensuring that you have the right to upload and use any Client Data, including content containing personal, sensitive, or confidential information.
5. Acceptable Use
You agree not to use CaseChat to:
- upload unlawful, harmful, or infringing content;
- take content from CaseChat
- breach professional confidentiality obligations or court orders;
- reverse engineer, disrupt, or interfere with the platform;
- bypass or attempt to bypass security measures;
- develop or train competing AI systems; or
- violate any applicable law or regulation.
We at our sole discretion reserve the right to suspend or terminate your access to CaseChat with or without cause.
6. AI-Generated Content and Limitations
CaseChat generates content based on user inputs. You acknowledge that:
- AI-generated outputs may be inaccurate, incomplete, or outdated;
- CaseChat does not provide legal advice;
- you must independently review and verify all generated content; and
- CaseChat is not responsible for any decisions made in reliance on such content.
7. Service Availability and Updates
We aim to provide reliable access to CaseChat but do not guarantee uninterrupted availability.
We may:
- modify or improve features;
- perform maintenance that affects availability; or
- discontinue the service or any part of it with reasonable notice.
Where practicable, we will provide advance notice of scheduled downtime.
8. Subscription Fees and Payment
If you have subscribed to a paid plan of CaseChat:
- pricing will be disclosed at the time of purchase or renewal;
- fees may be charged on a recurring (monthly or annual) basis;
- Unsuccessful fee collections may be retried at a future time
- subscriptions renew automatically unless cancelled; and
- refunds are provided only where required by law.
We reserve the right to change pricing with reasonable notice.
9. Intellectual Property
All intellectual property rights in CaseChat, including its software, design, algorithms, models, and branding, are owned by CaseChat or its licensors. Our license page can be found as follows.
Except as permitted by law, you must not:
- copy, reproduce, modify, or distribute any part of the platform;
- remove or alter proprietary notices; or
- use CaseChat property without prior written consent.
These Terms do not transfer any ownership rights to you.
10. Privacy
Your use of CaseChat is also governed by our Privacy Policy. By using the platform, you consent to the collection, use, and disclosure of your information as described in that policy.
11. Data Security
We implement reasonable, industry-standard safeguards to protect your data, including:
- encryption in transit and at rest;
- secure authentication processes;
- access controls; and
- regular security assessments.
However, no system is completely secure, and you acknowledge that risks remain.
12. Termination
We may suspend or terminate your access if:
- you breach these Terms;
- your use poses a risk to us or other users;
- required by law; or
- you fail to pay applicable fees.

CaseChat is provided on an “as is” and “as available” basis.
We make no warranties regarding the accuracy, reliability, or suitability of the platform or its outputs. We do not guarantee that any content generated will be legally correct, complete, or appropriate.
14. Limitation of Liability
To the fullest extent permitted by law:
- we are not liable for indirect, incidental, special, or consequential damages;
- we are not liable for loss of profits, business, data, or reputation; and
- our total liability is limited to the amount you paid to use CaseChat in the 12 months prior to the claim (if any).
15. Indemnification
You agree to indemnify and hold harmless CaseChat and its personnel from any claims, losses, damages, or expenses arising from:
- your use of the platform;
- your Client Data;
- your breach of these Terms; or
- your breach of any law or professional obligation.
16. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on our website with a revised “Last Updated” date.
Your continued use of CaseChat constitutes acceptance of any updated Terms.
17. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, unless otherwise required by applicable law.
