In accordance with the practice of the Federal Court in certain cases of public interest, the Court has prepared remarks to accompany the Determination that is to be delivered today but forms no part of the Determination.  It must be emphasised that the only authoritative pronouncement of the Court’s Determination is that contained in the published Determination.

Ngarluma/Yindjibarndi Native Title Determination

These native title applications have a long history.  There are 5 main features of the process to which I would like to refer.

  1. CLAIMS

The first claim was lodged on behalf of the Ngarluma and Yindjibarndi peoples with the National Native Title Tribunal on 27 July 1994.  The claim was filed in the Federal Court of Australia on 21 November 1996.  The claim area comprised the general area from middle reaches of the Fortescue River, following the escarpment of the Hamersley Ranges, northwards to the Indian Ocean, including the Dampier Archipelago. The western boundaries roughly corresponded with the Maitland River and the eastern boundaries were situated between the Balla Balla and Peawah Rivers. 

The second claim was lodged on behalf of the Yaburara and Mardudhunera peoples with the National Native Title Tribunal on 1 August 1996.  It was filed in the Federal Court of Australia on 7 November 1997.  It related to an area of approximately 4500 square kilometres so far as it overlapped the claim of the Ngarluma and Yindjibarndi peoples.  It covered the Burrup and surrounding islands, Chicester Ranges, Mt Leopold and the Nickol River.  

The third claim was lodged on behalf of the Wong-Goo-TT-OO peoples with the National Native Title Tribunal on 10 July 1998 and filed with the Federal Court of Australia on 30 September that year.  It related to an area of almost 13 000 square kilometres so far as it overlapped the claim of the Ngarluma and Yindjibarndi peoples including the Burrup, Pularra and Karratha. 

For those who require a more refined description of the claim areas, the Determination, which I will shortly publish, contains geographic coordinates, latitudes and longitudes and maps which should readily inform them. 

All together the claim areas covered almost 25 000 square kilometres. 

  1. EVIDENCE

The decision was made that evidence should be taken on country.  This involved the Court, the representatives of the parties and supporting staff moving around relevant sites in the claim area. 

The hearing of evidence commenced on 20 September 1999.  The first witness was called on 21 September 1999.  Evidence continued for a total of 40 days.  That covered the period from 21 September 1999 until 12 June 2000.  Included in this were 35 days of evidence ‘on country’.  80 witnesses were called, 78 of whom were indigenous.  Additionally, there were 21 expert witnesses.  They included anthropologists, archaeologists, historians and linguists.  Evidence was taken at 76 sites in the claim areas and at the Federal Court in Perth. 

At the suggestion of the Court, the staff maintained a daily diary.  With the cooperation of the applicants and other parties as well as witnesses, a photographic record of all witnesses was maintained which considerably enhanced subsequent reading of the transcript of evidence. 

The application came to the Court because of the passage by Parliament of the Native Title Act 1993 (Cth). By enactment of that Act the Parliament passed to the judiciary the task of detailed consideration of applications for recognition of native title. The objectives of the Act are stated in s 3 to be as follows:

(a)to provide for the recognition and protection of native title;

(b)to establish ways in which future dealings affecting native title may proceed and to set standards for those dealings;

(c)to establish a mechanism for determining claims to native title; and

(d)to provide for, or permit, the validation of past acts, and intermediate period acts, invalidated because of the existence of native title

By s 82(2) of the Native Title Act, the Court may adjust its procedures to ‘take account of the cultural and customary concerns of Aboriginal peoples’.  As a consequence of this, the Court directed that access and use of genealogical and expert reports be restricted, the Court also directed that evidence taken at some sites be subject to gender-restriction.

In the course of evidence, 295 items were received as exhibits or items marked for identification or as aide memoires. 

  1. SUBMISSIONS

Submissions were made in Perth on 11 to 15 December 2000.  However, final submissions did not take place until 25 February 2003 pending the outcome of the High Court’s decision in Ward v Western Australia.  Extensive written submissions were filed by the parties. 

  1. REASONS

As a consequence, reasons for decision were delivered on 3 July 2003 accompanied by a preliminary draft determination. 

Subsequently, other matters arose requiring further reasons for judgment.  On 5 December 2003, reasons were delivered concerning outstanding extinguishment issues.  On 2 July 2004, reasons were delivered concerning issues related to the formulation of the Determination and body corporate issues.  On 29 October 2004, reasons addressed extinguishment issues.  On 4 March 2005, reasons considered additional issues concerning the proposed Determination. 

  1. DETERMINATION

The final step for the parties was to settle the draft Determination to ensure that it gave effect to the Court’s reasons, and for experts to describe the claim area, the precise location of various tenements, tenures and features and record them on multicoloured maps.  That process has only recently been completed.

At the first opportunity thereafter the Court has now come to the claim area to hand down its Determination.  It is doing so because all parties, whether applicants or respondents, agreed that the Determination should be handed down by the Court at this site at Roebourne. 

In the reasons for judgment delivered on 3 July 2003, reference was made to the history of the claim areas.  It is not appropriate to repeat or to summarise that here, except to say this.  As the recording of the history discloses, Roebourne has had a particular and special part to play in the history of the Ngarluma and Yindjibarndi peoples and in other issues involving all Australians living in the community of the claim areas.  I accepted the submission of all the parties that the Determination should be handed down in Roebourne because, taking into account that history, it seemed to me overwhelmingly appropriate that at this place the act of determination should be made. 

The making of a determination is an act arising from the passage of the Native Title Act.  It is a legal act in itself giving recognition to two principal matters concerning the applications for native title.  The first is the recognition of native title where and if it has been found to have been made out.  Second, it is a recognition of where that title has been extinguished according to law.  It is not for the Court to take into account more than considerations of law.  Nevertheless, that having been done, it is appropriate that the Court recognise that, subject to the exercise of the rights of appeal, the making of the Determination here has a significance for future relations for all the parties who have participated in the application.  Where any of the parties have in the course of history known sadness or discouragement in the claim areas, the making of this Determination may give them cause for optimism concerning some important conditions relating to life in the area in the future.

There are some people who have been involved in the applications as applicants or witnesses who are no longer with us.  It is to be hoped that the making of the Determination will duly mark their contribution.

  1. APPRECIATIONS

On an occasion such as this, it is appropriate to acknowledge many persons whom have assisted in the making of the Determination: 

  • First, may I thank counsel and solicitors for all parties for their conscientious and professional application to the difficult issues of fact and law raised by the application from time to time. 

  • Second, may I thank my associates, who have assisted me throughout. 

  • Third, may I thank those responsible for organising the visits on country for the Court, which have been done with such high efficiency. 

  • Also, I thank the transcription service for its excellent service under sometimes quite unusual and challenging conditions. 

  1. CONCLUSION

It is a significant legal act for a judge to make a determination such as the Native Title Act envisages.  It is unusual because of its potential to govern the future in a significant way.  With recognition to the applicants and to all those who have appeared as respondents, I have a duty now to turn to the Determination which has been settled by the parties in accordance with the successive reasons of the Court.

I now make and publish the Ngarluma/Yindjibarndi Native Title Determination bearing the seal of the Federal Court of Australia.  I request the Deputy Registrar to attest the due making of the Determination and, with my Associate, to distribute copies to the parties.

THE COURT ORDERS AND DETERMINES THAT:

Determination Area

  1. The ‘Determination Area’ is the land and waters described and depicted in the First Schedule.

Existence of native title

  1. Native title does not exist in relation to the following parts of the Determination Area:

    (a)the ‘Burrup’ (as described and depicted in the First Schedule);

    (b)‘Offshore Waters’ (as described and depicted in the First Schedule);

    (c)‘Depuch Island’ (as described and depicted in the First Schedule);

(d)the ‘Hamersley Ranges Area’ (as described and depicted in the First Schedule);

(e)the ‘Total Extinguishment Area’ (as described and depicted in the First Schedule).

  1. Subject to paragraph 2 above, native title rights and interests exist in the following parts of the Determination Area:

    (a)‘Ngarluma Native Title Area’ (as defined in the First Schedule); and

    (b)‘Yindjibarndi Native Title Area’ (as defined in the First Schedule),

    including the ‘Section 47A Area’ and the ‘Section 47B Area’ (as described in the Fifth Schedule) in respect of which extinguishment is disregarded in accordance with sections 47A and 47B of the Native Title Act 1993 (Cth).

  2. The native title rights and interests:

    (a)do not confer possession, occupation, use and enjoyment of land or waters on the native title holders to the exclusion of others; and

    (b)are not exercisable otherwise than in accordance with and subject to traditional laws and customs for personal, domestic and non-commercial communal purposes (including social, cultural, religious, spiritual and ceremonial purposes).

Native title holders

  1. The non-exclusive native title rights and interests which exist in the Determination Area are held by:

    (a)‘Ngarluma People’ (as defined in the Third Schedule) in relation to the Ngarluma Native Title Area; and

    (b)‘Yindjibarndi People’ (as defined in the Third Schedule) in relation to the Yindjibarndi Native Title Area.

Native title rights and interests

  1. Subject to paragraphs 4 and 8 to 15 inclusive, the Ngarluma People have the following non-exclusive native title rights and interests in relation to the Ngarluma Native Title Area:

    (a)A right to access (including to enter, to travel over and remain);

    (b)A right to engage in ritual and ceremony (including to carry out and participate in initiation practices);

    (c)A right to camp and to build shelters (including boughsheds, mias and humpies), limited to the proximity of river courses within the Ngarluma Native Title Area, and to live temporarily thereon as part of camping or for the purpose of building a shelter;

    (d)A right to fish from the waters, limited to the coastal areas landward of the low water mark, and inland water courses;

    (e)A right to collect and forage for bush medicine;

    (f)A right to hunt and forage for and take fauna (including fish, shell fish, crab, oysters, sea turtle, dugong, goanna, kangaroo, emu, bush turkey, echidna, porcupine, witchetty grub, swan), limited in the case of water fauna to coastal waters landward of the low water mark and inland water courses;

    (g)A right to forage for and take flora (including timber logs, branches, bark and leaves, gum, wax, Aboriginal tobacco, fruit, peas, pods, melons, bush cucumber, seeds, nuts, grasses, potatoes, wild onion and honey);

    (h)A right to take black, yellow, white and red ochre;

    (i)A right to take water for drinking and domestic use;

    (j)A right to cook on the land including light a fire for this purpose, limited to the proximity of river courses;

    (k)A right to protect and care for sites and objects of significance in the Ngarluma Native Title Area (including a right to impart traditional knowledge concerning the area, while on the area, and otherwise, to succeeding generations and others so as to perpetuate the benefits of the area and warn against behaviour which may result in harm, but not including a right to control access or use of the land by others).

  2. Subject to paragraphs 4 and 8 to 15 inclusive, the Yindjibarndi People have the following non-exclusive native title rights and interests in relation to the Yindjibarndi Native Title Area:

    (a)A right to access (including to enter, to travel over and remain);

    (b)A right to engage in ritual and ceremony (including to carry out and participate in initiation practices);

    (c)A right to camp and to build shelters (including boughsheds, mias and humpies), limited to the Millstream-Fortescue Area, and to live temporarily thereon as part of camping or for the purpose of building a shelter;

    (d)A right to fish from the waters, limited to the Millstream-Fortescue Area;

    (e)A right to collect and forage for bush medicine, limited to the Millstream-Fortescue Area and the upper reaches of the Sherlock River;

    (f)A right to hunt and forage for and take fauna (including fish, shell fish, crab, oysters, goanna, kangaroo, emu, turkey, echidna, porcupine, witchetty grub and swan but not including dugong or sea turtle), limited to the Millstream-Fortescue Area and the upper reaches of the Sherlock River;

    (g)A right to forage for and take flora (including timber logs, branches, bark and leaves, gum, wax, Aboriginal tobacco, fruit, peas, pods, melons, bush cucumber, seeds, nuts, grasses, potatoes, wild onion and honey), limited to the Millstream-Fortescue Area and the upper reaches of the Sherlock River;

    (h)A right to take black, yellow, white and red ochre, limited to the Millstream-Fortescue Area;

    (i)A right to take water for drinking and domestic use;

    (j)A right to cook on the land including light a fire for this purpose, limited to the Millstream-Fortescue Area;

    (k)A right to protect and care for sites and objects of significance in the Yindjibarndi Native Title Area (including a right to impart traditional knowledge concerning the area, while on the area, and otherwise, to succeeding generations and others so as to perpetuate the benefits of the area and warn against behaviour which may result in harm, but not including a right to control access or use of the land by others).

  1. The non-exclusive native title rights and interests in relation to the ‘Inter-tidal Zone’ (defined in the First Schedule) do not include the rights in subparagraphs (b), (c), (e), (g), (h), (i), (j) or (k) of paragraph 6 above.

  2. The non-exclusive native title rights and interests in relation to the ‘Offshore Islands’ (defined in the First Schedule) do not include any of the native title rights and interests in subparagraphs (a)-(j) of paragraph 6 above.

  3. The non-exclusive native title rights and interests in relation to the ‘Cemetery Reserve Area’ (defined in the First Schedule) do not include:

    (a)the right to engage in ritual and ceremony referred to in subparagraph (b) of paragraph 6 above, save to the extent it relates to ritual and ceremony for the dead; or

    (b)any of the rights in subparagraphs (c), (d), (h), (j) and (k) of paragraph 6 above.

  4. The non-exclusive native title rights and interests in relation to the ‘Telstra Area’ (defined in the First Schedule) do not include:

    (a)a right to remain (part of right (a) in paragraphs 6 and 7 above); and

    (b)right (c) in paragraphs 6 and 7 above.

  5. The non-exclusive native title rights and interests in relation to the ‘Telstra Cable Routes’ (defined in the First Schedule) do not include right (h) in paragraphs 6 and 7 above, to the extent that the right involves digging beneath the surface of that land.

Qualifications

  1. Notwithstanding anything in this determination, there are no native title rights and interests in or in relation to:

    (a)minerals (including ochres to the extent they are minerals) as defined in the Mining Act 1904 (WA), or in the Mining Act 1978 (WA) before the date of this determination; or

    (b)petroleum as defined in the Petroleum Act 1936 (WA), or in the Petroleum Act 1967 (WA) before the date of this determination.

  2. There are no native title rights and interests in respect of ‘Subterranean Waters’ (as defined in the First Schedule) in the Determination Area.

  3. The non-exclusive native title rights and interests are subject to and exercisable in accordance with the laws of the State and the Commonwealth including the common law.

Other interests

  1. The nature and extent of other interests in those parts of the Determination Area where native title exists are set out in the Second Schedule.

  2. The relationship between the non-exclusive native title rights and interests and the other interests referred to in paragraph 16 is that:

    (a)to the extent that any other interest is a category D past act, a category D intermediate period act or a future act under the Native Title Act 1993 (Cth), or is an act to which sections 47A or 47B Native Title Act 1993 (Cth) applies, and is inconsistent with the continued existence, enjoyment or exercise of the native title rights or interests, the native title continues to exist in its entirety, but the native title rights and interests have no effect in relation to the other interests to the extent of the inconsistency during the currency of those other interests;

    (b)in the case of mining leases, pastoral leases, easements and licences granted prior to 1 January 1994, the construction or erection of an improvement required or permitted under such a lease or easement or licence will prevent the exercise of the non-exclusive native title rights and interests at the location of that improvement to the extent that the exercise of those rights are inconsistent with the improvement for so long as the holder of the lease, easement or licence retains the improvement; and

    (c)otherwise, the existence and exercise of the native title rights and interests does not prevent the doing of any activity required or permitted to be done by or under the other interests, and the other interests, and the doing of any activity required or permitted to be done by or under the other interests, prevail over the native title rights and interests and may prevent any exercise of the native title rights and interests, but does not extinguish them.

Orders

  1. The Yindjibarndi Aboriginal Corporation is to hold the native title rights and interests of the Yindjibarndi People in trust for the Yindjibarndi People.

  1. Within 6 months of the date of this order, Daisy Moses, Roger Barker, Jill Churnside, Trevor Solomon and Les Hicks on behalf of the Ngarluma People are to file and serve:

    (a)a notice in accordance with section 56(2)(a) of the Native Title Act 1993 (Cth) indicating whether the Ngarluma People intend to have their native title held in trust by a prescribed body corporate alternatively whether they intend to have a prescribed body corporate perform the functions in section 57(3) of the Native Title Act 1993 (Cth); and

    (b)if the Ngarluma Peoples' native title is to be held in trust - the name and the rules of the proposed prescribed body corporate and the written consent of the prescribed body corporate;

    (c)if the Ngarluma Peoples' native title is to be held by the common law holders with a prescribed body corporate to perform the functions in sub-section 57(3) of the Native Title Act 1993 (Cth) - the name and the rules of the proposed prescribed body corporate.

  2. Any party has liberty to apply within 21 days from the date the name and the rules of the proposed prescribed body corporate are filed and served in accordance with order 19 above.

  3. If order 19 is not complied with in the time specified then it is determined that the native title rights and interests of the Ngarluma People are held by the Ngarluma People as common law holders.

  4. If the native title rights and interests of the Ngarluma People are held by the Ngarluma People as common law holders in accordance with order 21 above then the matter is to be relisted by the Registrar in order that the Court can consider the making of orders in accordance with section 57(2) of the Native Title Act 1993 (Cth).

  5. Until such time as there is a registered native title body corporate in relation to the native title rights and interests of the Ngarluma People, any notices required under the Native Title Act 1993 (Cth) or otherwise to be served on the Ngarluma native title holders or the Ngarluma registered native title claimants may be served on the representative Aboriginal/Torres Strait Islander body in relation to the land or waters concerned or such other address for service for the Ngarluma People as may be notified to the Court and the parties by the said representative Aboriginal/Torres Strait Islander body, and such service shall be deemed to be sufficient.

  6. Applications WAD 127 of 1997 and WAD 6256 of 1998 and WAD 6169 of 1998 are, to the extent they overlap with application WAD 6017 of 1998 (as depicted in the Fourth Schedule), dismissed, such dismissal being without prejudice to any rights the members of the native title claim group in respect of application WAD 6256 of 1998 may have as Ngarluma People or Yindjibarndi People (and not as Wong-goo-tt-oo) to be native title holders.

  7. No order as to costs.

DEFINITIONS

Burrup’ means the land and waters shaded in green on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Cemetery Reserve Area’ means the land and waters the subject of reserves 5698, 30904 and 41146, as shaded in orange on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Depuch Island’ means Depuch Island landward of the low water mark, as shaded in dark green on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Determination Area’ means the land and waters described in Attachment 1 to this First Schedule, being the land and waters bordered in light blue on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Hamersley Ranges Area’ means the land and waters shaded light brown on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Inter-tidal Zone’ means that part of the Ngarluma Native Title Area which is between mean high water mark and mean low water mark, as shaded in orange on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Millstream-Fortescue Area’ means the land and waters bordered and hatched in green on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Ngarluma Area’ means the land and waters bordered and hatched in dark blue on the maps marked ‘Map 1’ which are Attachment 2 to this First Schedule.

Ngarluma Native Title Area’ means the Ngarluma Area but not including the Ngarluma Total Extinguishment Area.

Ngarluma Total Extinguishment Area’ means the land and waters the subject of the following interests:
