CaseChat Overview and Summary
Classic Gourmet Sausages Pty Ltd, along with its directors, Mr and Mrs Turner, appealed against a decision of the ACT Tenancy Tribunal which dismissed their notice of dispute. The notice of dispute was brought under the Residential Tenancies Act 1997. The respondent to the appeal was Leda Commercial Properties Pty Ltd. The primary issue before the court was whether the ACT Tenancy Tribunal had the power to dismiss the notice of dispute on the basis that no reasonable cause of action was disclosed. This issue arose from the Tribunal's dismissal of the Turner's notice of dispute, which was based on the contention that the lessor's conduct was harsh, oppressive, and unconscionable. The court considered whether the Tribunal had the requisite power to dismiss the notice of dispute under section 139 of the Magistrates Court (Civil Jurisdiction) Act 1982.
The court found that the Tribunal did indeed have the power to dismiss the notice of dispute if it was satisfied that no reasonable cause of action was disclosed. The court relied on the broad language of section 54 of the Act, which allows the Tribunal to grant relief as if it had the jurisdiction of the Magistrates Court. Given that the Magistrates Court has the power to dismiss proceedings under section 139, the court concluded that the Tribunal could do the same. The court also noted that the lack of available evidence from other tenants, despite requests to subpoena them, supported the Tribunal's decision to dismiss the notice of dispute. The court held that the Turner's reliance on potential future evidence did not substantiate their claim at the time of the hearing.
In light of the court's findings, the appeal brought by Classic Gourmet Sausages Pty Ltd was allowed, and the notice of dispute was remitted to the ACT Tenancy Tribunal for further hearing. The court ordered that Classic Gourmet Sausages Pty Ltd be added as a party to the appeal, and the appeal as brought by Mr and Mrs Turner was dismissed. Additionally, the respondent was ordered to pay the costs of the appellants in relation to the appeal to the Supreme Court of the Australian Capital Territory.
