White v Repatriation Commission [2004] FCA 633 [2004] FCA 633 24 MAY 2004

CaseChat Overview and Summary

This appeal concerns the applicant’s challenge to the decision of the Veterans’ Review Board affirming a decision of the Repatriation Commission that the applicant’s claims for personality disorder, anxiety disorder and associated alcohol dependence or abuse were not war-caused within the meaning of the Veterans’ Entitlements Act 1986. The applicant, Mr White, enlisted in the Royal Australian Navy on 1 April 1967 and has operational service in South Vietnam from 21 May 1968 to 13 June 1968 and from 13 November 1968 to 28 November 1968. He claims that he suffers from generalised anxiety disorder with alcohol dependence or abuse as a result of incidents that occurred on his first voyage to South Vietnam on or about 1 June 1968. The legal issues before the court were whether the applicant's claims for psychiatric illness were war-caused within the meaning of the Veterans’ Entitlements Act and whether the Veterans’ Review Board was correct in affirming the decision of the Repatriation Commission. The court considered the evidence and submissions of both parties and examined the statutory provisions and relevant case law. The court found that the applicant's claims were not supported by sufficient evidence to establish that the claimed psychiatric illnesses were war-caused within the meaning of the Veterans’ Entitlements Act. The court also found that the Veterans’ Review Board was correct in affirming the decision of the Repatriation Commission. The appeal was dismissed, and the applicant was ordered to pay the respondent's costs.
