Zogiannis v Stevens

Zogiannis appealed against a decision of the Magistrates’ Court, which had dismissed their claim for damages for motor vehicle property damage. Consequently, the appeal was allowed, and the matter was remitted to the Magistrates’ Court for re-assessment of the damages in accordance with the correct legal principles.

The court ordered that the Magistrates’ Court was to re-assess the damages for motor vehicle property damage, taking into account the correct application of the principles for measuring damages, as outlined in the Motor Accidents Act 1986 (Vic).
