Scott v Handley

The appeals before the Court were brought by Ralph and Sophie Scott against orders of Heerey J, a single judge of the Federal Court, who dismissed their respective applications for judicial review on 15 October 1998. The sole ground of appeal was that the judge had wrongly refused to adjourn the proceedings when they came before him on that date. The Court found in favour of the appellants, allowing the appeals and setting aside the orders made by Heerey J. The Court's reasoning was based on the significant delay in the provision of affidavit material by the respondents, which had not been brought to the trial judge's attention. This delay had likely impaired the appellants' ability to prepare adequately for the final hearing. The Court held that the refusal to grant the adjournment resulted in a miscarriage of justice, as the appellants, being unrepresented litigants, were at a significant disadvantage compared to the respondents, who were officers of the Commonwealth. The Court emphasised the importance of fair dealing in litigation, particularly when one party is unrepresented, and found that the second respondent had fallen short of the standard properly to be expected of the Commonwealth. Consequently, the appeals were allowed, the orders of Heerey J were set aside, and the proceedings were remitted to Heerey J for directions for final hearing. The respondent Secretary, Department of Social Security was ordered to pay the appellants' costs of the appeals, if any.
