CaseChat Overview and Summary
The applicant in this case, Mr Reurich, who suffers from social communication disorder, paranoid personality disorder, and attention deficit/hyperactivity disorder, sought a declaration that the respondent, Club Jervis Bay Ltd, had unlawfully discriminated against him on the basis of his disability and his assistance animal, Boofhead. The case was heard in the Federal Circuit Court of Australia, where Judge Ryan was the presiding judge. The primary legal issues were whether Boofhead qualified as an assistance animal under the Disability Discrimination Act 1992 (Cth) and whether the respondent had unlawfully discriminated against Mr Reurich due to his disability or his dog.
The court found that Boofhead was indeed an assistance animal for the purposes of the Disability Discrimination Act, as he was trained to assist Mr Reurich in managing his disabilities. The court noted that the respondent had unlawfully discriminated against Mr Reurich on two separate occasions. The first incident occurred when Mr Reurich visited the Club with Boofhead, and the Club staff confiscated Boofhead’s licence and did not return it to Mr Reurich. The second incident took place on the courtesy bus when a staff member verbally abused Mr Reurich and ordered him to leave the bus. The court held that these incidents amounted to unlawful discrimination under the Act.
The court ordered the respondent to pay Mr Reurich damages in the sum of $16,000 plus interest for the pain and suffering he had experienced due to the respondent’s unlawful conduct. The court also directed the parties to submit written arguments regarding the costs of the proceeding, to be determined either on the papers or through an oral hearing.
