He was sentenced to a term of 5 vears lrnprlsonment wlth a mlnlmum of 2 1 / 2 years before he would be ellglble for parole.

On appeal thls was reduced

to 3

years wlth an 18 month

minlnum.

tle was released from prlson on 18 Octoher 1986.

A declslon to deport the anpllcant

had Seen made on 19

Auqust 1986 under s.12

of the Mlgratlon Act

1958. He

appealed

agalnst that declslon to the Admlnlstratlve Appeals Tribunal.

On 29 January 1987 Deputy Presldent Nlcholson ordered

that the

declslon

be

remltted

respondent

to

he

for

reconslderatlon In accordance wlth

the Trlbunal's recommendatlon

that the deportatlon order be revoked.

The appllcant next

heard of the matter on

7 July 1987

when he received a letter dated 1 July 1987 from the Department of

Immigration

and Ethnlc Affalrs advlslng him that the respondent

had decided not to accept the recommendatlon. Consequently, he was informed, it was proposed to proceed with the deportatlon order.

The appllcant has, it 1s sald, been qlven no opportunlty to be heard on the questlon of the disposltlon of the 'Irlbunal's recommendatlon.

He conplains that he has been denied natural lustice

and

seeks ~udicial

review of the Minister's decision.

H1s

application also raises unspecified non-observance

of procedures required by law to be observed and improper exercise

of the power conferred by the Migration Act. Nothing that was not

of a purely speculative nature was advanced in support of these

latter grounds and

in my opinion, no relief could

be qranted in

relation to them on present materials.

The decision by the Minister to refuse

to accept the

recommendatlon of the Tribunal is an unusual one.

So much is recognised by the Ministerial Statement on Australian Criminal Deportation Policy made

in the Parliament

by

the then Minister, the Honourable Stewart West, on

4 May 1983.

In particular paragraphs 3 and 4 of that Policy are

apt :-

" 3 .

A person who has come within the criminal deportation liability has a right to a decislon on

hls/her

case as soon

as possible after sentencing

and a right to appeal to the Administrative Appeals

Tribunal

against

a declslon

that

he/she

be

deported.

4 .

It is the policy of the Australian Government that

recommendatlons of the Administrative

Appeals

Tribunal should be overturned by the Minister only

in exceptional circumstances

and

only when strong

evidence can be produced

to lustify his decision.

Furthermore, it is the policy of the Government that, when the Minlster decides to deport a person

the

Tribunal's recommendatlon.

Counsel for the respondent

unable to lnEorm me

whether there had been any more such cases since 1982.

On the authorlty of the Rarbaro declslon

it 1s plaln

that there

1s at least

a case to argue the exlstence of an

entitlement on the part O E a prospectlve deportee to be heard before a declslon 1s made departlng from a recommendatlon of the

Tribunal that a deportatlon order

be revoked.

Smithers J.,

after cltlnq the decislon of the Hlqh Court

in Mlnlster for Immigratlon and Ethnlc Affalrs

v Pochl (1981) 36

ALR 561, said at 130 in the Barbaro 1udqment:-

"It appears, therefore, that there

1s a duty In the

Mlnlster arlslnq out of the fact that

the Trlbunal has

made a particular recommendatlon.

He must proceed "In

the llght" of It, he must "have reqard"

to It.

It is

not to be thought that thls duty

1s not a real one. It

is not to be thought that Parllament dld

not Intend that

the recommendatlon of

the Tribunal should be meanlngful.

The matter cane on before me as a matter of urgency in

the early eveninq

of 2 2 J u l y 1987.

I made an interim order

restralning the respondent fron denorting the applicant

u n t ~ l

midday on 2 3 July so that I miqht consider my decisiqn on the stay

overnight. In

m y opinion, the balance

of convenience plainly

favours the applicant. The order I make IS, I think, able to be made under s.15 of the Admlnlstratlve Decisions (Judicial Review)

-

Act and if that section be inapplicable then s . 2 3 of the Federal

Court of Australia Act supplies the necessarv powers.

The orders I propose are as follows:-
