CaseChat Overview and Summary

Fineff v The King involved an appeal against a sentence imposed on the appellant, Fineff, who had been convicted of twelve offences of obtaining financial advantage by deception. The court was required to consider whether the aggregate sentence of nine years imprisonment, with a non-parole period of five years and four months, was manifestly excessive. The appellant had committed fraud amounting to over $3.3 million over a period of three and a half years, targeting many elderly victims, causing them substantial financial harm and emotional distress.

The legal issues before the court were whether the sentence was manifestly excessive and whether the totality of the circumstances, including the appellant’s early plea of guilty and assistance to authorities, warranted a lesser sentence. The court considered the appellant’s subjective circumstances, which were highly favourable, against the objective gravity of the offending, which included the significant financial harm caused to the victims and the prolonged nature of the offending.

The court determined that the sentence was not manifestly excessive. It took into account the appellant's early guilty plea and cooperation with authorities, but emphasised the significant harm caused to the victims and the appellant’s prolonged offending period. The court also compared the sentence with those in comparable cases, finding that the sentence imposed was commensurate with the gravity of the offending. Consequently, the appeal was dismissed, affirming the original sentence.

The final orders of the court were that the appeal against sentence was dismissed, and the original sentence of nine years imprisonment with a non-parole period of five years and four months was upheld.
