CaseChat Overview and Summary

The applicants, David Catania and Christopher Catania, claim rectification of defects to the floor sanding and staining work performed in July 2018 on the upper floor of the applicants’ home. The applicants claim damages, the filing fee and the cost of an Australian Timber Flooring Association (ATFA) report. The respondents, Mark Ivan Jolley and Brisbane Timber Floors Pty Ltd (BTF), deny the applicants’ claims and make a counter-application for the balance owing of the itemised list of work performed in the amount of $10,720 and for costs. The applicants claim in negligence is against BTF. The respondents claim in negligence is against Mr Jolley personally. The informal contract entered into between BTF and Mr David Catania, as undisclosed agent for Mr Christopher Catania, did not comply with the minimum requirements under the Queensland Building and Construction Commission Act 1991 (Qld) (QBCC Act) and is, therefore, of no effect and is unenforceable. The Tribunal has previously found that a party to such a contract cannot maintain a claim for damages for breach of contract but a claim for damages for work negligently performed may be available. I find that the claim described in the Application is arguably a claim for damages for negligently performed work. For the reasons set out below, I find that Mr Jolley and BTF are liable to Mr Christopher Catania for damages for defective work negligently performed in the sum of $13,770 (incl GST). I find that Mr Jolley breached his duty of care to exercise reasonable care and skill. I find that Mr Christopher Catania was not contributory negligent. I find that proportionate liability does not apply to this claim. I find that BTF and Mr Jolley are not concurrent wrongdoers. I order that Mark Ivan Jolley and BTF must pay Christopher Catania the sum of $13,770 (incl GST) by 4.00pm on 21 January 2022. The counter-application is dismissed.
