The union argued that the clause only permitted transfers that involved a significant change in the locality, such as moving from one capital city to another or from a country town to a capital city. The Treasurer contended that the clause was broader and allowed for transfers within the same metropolitan area.

The court found that clause 11.1.1(c) of the Award, when properly interpreted, did not permit compulsory transfers within the same metropolitan area. The court held that the clause imposed a test of different "locality," which was only met when the compulsory relocation of duties was from one capital city to another or on a similar scale, such as from a country town to a capital city. The court emphasised that it would be necessary and reasonable for the employee to move house in order to maintain employment for the test to be satisfied. Consequently, the court declared that the clause did not support transfers within the same metropolitan area and dismissed the application in all other respects.
