Background
This decision is pursuant to an opposition brought by Nine Network Australia Pty Ltd (‘the Opponent’) under s 52 of the Trade Marks Act 1995 (‘the Act’) to the registration of the trade mark subject of application number 1447735 in the name of 9 Strategic Pty Ltd (‘the Applicant’).
Relevant details of the opposed application are as follows:

The application was examined as required by s 31 of the Act and in due course accepted for possible registration. Acceptance of the application was advertised in the Australian Official Journal of Trade Marks on 5 September 2013.
The Opponent filed a Notice of Intention to Oppose registration of the application on 4 November 2013.
Shortly thereafter the Opponent filed a request that the Registrar revoke acceptance of the application, apparently under the misconception that the numeral ‘9’ in the Trade Mark had been considered only as the letter ‘g’ by the examiner and not as a numeral.[1] The Registrar declined to revoke acceptance.
[1] At the time of examination the trade mark was indexed, for searching purposes, as the letter ‘g’ rather than the numeral ‘9’. However file documents show that the examiner searched the Australian Trade Mark Online Search System (‘ATMOSS’) using search terms including letter ‘g’, the numeral ‘9’ and the word ‘nine’, and conducted research upon the internet using the search terms ‘9 strategic’, ‘9>strategic’ and ‘g strategic’. These documents were made available to the Opponent pursuant to a request under the Freedom of Information Act 1982 (Cth), and the Registrar informed the Opponent, in declining to revoke acceptance, that variants of both ‘9’ and ‘g’ were considered by the examiner.
On 2 December 2013 the Opponent filed a Statement of Grounds and Particulars, particularising grounds of opposition under ss 44, 58, 60, 42(b), 62A and 62(b). The Applicant filed a Notice of Intention to Defend the application on 17 December 2013, following which the parties filed evidence in support of their cases (described in more detail below).
The parties requested a hearing and the matter came before me, a delegate of the Registrar of Trade Marks, at a hearing in Sydney on 14 August 2015. Neil Murray of Counsel, instructed by Stuart Green and Amanda Wong of Dibbs Barker law firm, appeared for the Opponent. Khajaque Kortian, assisted by Francesca Colubriale, of Spruson & Ferguson Patent & Trade Mark Attorneys, appeared for the Applicant.

I summarise below what I consider to be the relevant facts presented in the parties’ evidence.
Opponent’s evidence
The Opponent is one of Australia’s primary television broadcasting networks. It commenced broadcast operations in 1956 (via its predecessor in business Sir Frank Packer) and it is declared that the numeral ‘9’ and the word ‘Nine’ have been its broadcast channel and station identifiers (with the exception of certain regional stations identified by ‘NBN’ or ‘WIN’) since that time. Through free-to-air television licenses and affiliate network agreements it has a national audience. Evidence relating to viewer ratings indicates it is one of the highest rating broadcasters.
The Opponent owns the following trade marks (a full list of their respective goods and services appears at Annex 1 to this decision).

In 1970 the Opponent commenced using a logo comprised of nine dots which appears alongside the numeral ‘9’, or at times in conjunction with the word ‘Nine’. Printed materials of the Opponent, including promotional material and stationery, generally display this logo in its various iterations as it has evolved over time. It likewise appears on broadcast television (it is declared approximately 400 times per 24 hour period) and upon the websites and social media platforms that the Opponent utilises.
Verbally the Opponent is referred to as ‘Nine Network’, ‘Network Nine’ or ‘Channel Nine’. Videos of Opponent’s advertisements are in evidence which contain voiceovers referring to ‘Channel 9’ and various programs ‘on 9’. The Opponent declares further that ‘Nine’ and ‘9’ comprise its ‘house brand’.
The Opponent sponsors many events, including high profile events, at which its indicia are displayed. It also heavily promotes programs that appear on its network, including by way of outdoor signage (such as on taxis, buses and bus shelters), television advertisements, social media and magazines, upon which its indicia appears.
An important source of revenue for the Opponent is the sale of advertising time during broadcasts, which it characterises as ‘commercials’, and the ‘provision of advertising services to third parties which facilitates the promotion and sale of third party goods and services’, which it characterises as ‘advertorials’. Revenue figures are provided for these activities and they are substantial.
The Opponent operates a website at < of which screen shots are in evidence. One of them states, under ‘About Nine Access’, ‘Nine Access provides insights into the latest from the Nine Network into the hands of its most important partners and stakeholders. The media hub is home to TV program information from Nine GO! and GEM, as well as TV schedules, Talent Bios and Press Releases’.
One of the businesses of the Opponent is ‘Powered by Nine’, a business ‘engaged in the provision of strategic media planning and advertising and marketing buying services’. A poster in evidence indicates that the nature of the business is the provision of advice and information about programs appearing on the Nine network which may complement the brands of parties that wish to advertise upon the network (or within other media that the Opponent is associated with, such as magazines or digital platforms). However no other information about the business is included, such as when it commenced operations, how many customers it has, its sales volumes and so on.
The Opponent has sold merchandise relating to some of the programs it broadcasts, particularly the children’s program ‘Hi-5’, and has published ‘spin off’ magazines relating to some of its programs such as ‘Money’, ‘The Block’ and ‘Burke’s Backyard’, which display the logo of nine dots in combination with the numeral ‘9’.
Lastly, in its evidence in reply the Opponent’s attorney adduces three sets of extracts from ATMOSS of registered or accepted trade marks in class 35, being:
· those which include the word ‘Nine’ and/or the numeral ‘9’ but are not in respect of advertising, marketing, promotional, branding or broad business services;
· those which include the word ‘Nine’ and/or the numeral ‘9’ but not as the mark’s prefix or the mark’s most distinctive or memorable portion, and are in respect of advertising, marketing, promotional, branding or broad business services; and
· those which include the word ‘Nine’ and or the numeral ‘9’, in the name of the Opponent and companies related to the Opponent.
Applicant’s evidence
The Applicant is a marketing company ‘that provides advisory services, and in particular, strategic marketing services, to Australian businesses’. It was founded in Queensland in 2011 and now has 12 staff with offices in Sydney, Melbourne and Brisbane. Its customers are primarily mid-tier Australian businesses.
The Applicant also owns trade mark registration 1447736, depicted below, which was filed on the same day as the Trade Mark and is in respect of the same services.
In respect of it the Applicant states:
The name “9 Boxes” (and subsequently “9 Strategic”) was chosen by [the Applicant’s co-founders] because we wanted to adopt a name based on a graphic representation of the 9 principles or “boxes” of strategic marketing, namely:
(i)Position
(ii)Capability
(iii)Channel
(iv)Buyer’s journey
(v)Communication
(vi)Starting conversations
(vii)Product/service
(viii)Client management; and
(ix)Client service.
The Applicant has created a guide based on these principles which it distributes to clients and has published upon its website. It also creates other documents based upon the application of these principles for specific clients that engage its services, an example of which is in evidence dated August 2014.
The Trade Mark is used upon promotional materials such as business cards, letterhead paper and coasters (examples of which are in evidence). It is also used upon the Applicant’s website, declared to have gone ‘live’ in 2011. I note that the Applicant’s website address is The Applicant’s founders present and/or attend industry events and, it declares, when speaking or presenting use materials displaying the Trade Mark. An article about the Applicant appeared in the August 2013 edition of BRW magazine, which does not appear to show the Trade Mark but refers to the Applicant as ‘9 Strategic’.
It appears that the Applicant provides its services to businesses in return for a fixed monthly fee, usually over the course of 12 months. Sample invoices are provided which prominently display the Trade Mark, the earliest of which is dated 31 May 2014.
Sales figures for the financial years ending 30 June 2012 to 30 June 2014 are provided which I would characterise as modest, although not insignificant.
The Applicant declares that it is not aware of any instances of confusion between the Applicant and the Opponent.
Lastly, the Applicant’s attorney adduces extracts from ATMOSS of all trade marks that have been accepted or registered in class 35 and which comprise or contain the numeral ‘9’ or the word ‘nine’.
Grounds and Onus
At the hearing the Opponent pursued all of the grounds particularised in the Statement of Grounds and Particulars, being those in respect of ss 44, 58, 60, 42(b), 62A and 62(b) of the Act.
The onus is upon the Opponent to establish at least one ground of opposition on the balance of probabilities.[2] The time at which the ground of opposition must be established is the date of filing of the application,[3] being 7 September 2011.

As will be seen I find the ground of opposition under s 60 is established and it is therefore only necessary for me to address that ground in these reasons.
Section 60
Section 60 of the Act provides:
Trade mark similar to trade mark that has acquired a reputation in Australia
The registration of a trade mark in respect of particular goods or services may be opposed on the ground that:
(a) another trade mark had, before the priority date for the registration of the first-mentioned trade mark in respect of those goods or services, acquired a reputation in Australia; and
(b) because of the reputation of that other trade mark, the use of the first-mentioned trade mark would be likely to deceive or cause confusion.
Therefore to establish the ground of opposition under section 60 the Opponent must demonstrate that its trade mark(s) had acquired a reputation in Australia such that by 7 September 2011 the use of the Trade Mark by the Applicant in respect of the nominated services would be likely to deceive or cause confusion. In this regard the Opponent submits that its trade marks listed in Annexure 1 to this decision have acquired a reputation in Australia. On its face I do not agree with this submission: some of the trade marks identified do not appear in the evidence at all, and others have only minimal presence. That being the case, I will begin with the premise that the trade marks upon which the s 60 ground is based are the numeral ‘9’ and the word ‘Nine’, as these are the specific trade marks most often identified by the Opponent in its submissions (as opposed to the Opponent’s references to ‘the Nine Trade Marks’, defined as encompassing all of those at Annexure 1).
Reputation in this context refers to the recognition of the Opponent’s marks by the public generally,[4] although the size and nature of the relevant market must be taken into account.[5] It is not a requirement of s 60 that the respective services of the parties be of any specified standard of similarity, nor is it a requirement that the respective trade marks are substantially identical or deceptively similar. Nonetheless I bear in mind the observations by delegates of the Registrar that confusion cannot arise solely from reputation but also from some level of similarity between the trade marks (be it deceptive similarity or something less, no matter how small);[6] and that confusion or deception may be likely where very little, if any, nexus exists between the goods and/or services in question depending on the strength of reputation and degree of similarity between the trade marks.[7]

As cited by the Opponent, Kenny J in McCormick & Co v McCormick[8] observed that:
In practice, it is commonplace to infer reputation from a high volume of sales, together with substantial advertising expenditures and other promotions, without any direct evidence of consumer appreciation of the mark, as opposed to the product.

Her Honour also cited Lockhart J in ConAgra Inc v McCain Foods (Aust) Pty Ltd:[9]
[R]eputation within the jurisdiction may be proved by a variety of means including advertisements on television or radio, or in magazines and newspapers within the forum. It may be established by showing constant travel of people between other countries and the forum, and that people within the forum (whether residents there or persons simply visiting there from other countries) are exposed to the goods of the overseas owner...

To establish a reputation in its trade marks the Opponent points to:
· The use from 1956 of ‘9’ and ‘Nine’ as the Opponent’s station identifier;
· The substantial revenue generated by the Opponent by its sale of advertising time;
· The substantial advertising and promotion of the Opponent’s services;
· The inclusion, in broadcasts since the early 1970’s, of voiceovers referring to ‘9’ (as part of ‘channel 9’ and ‘on 9’) and on-screen corporate identifiers containing the numeral ‘9’ or word ‘Nine’ (most often accompanied by the logo of nine dots), which are declared to appear approximately 400 times per 24 hour period;
· Expenditure in developing the on-screen corporate identifiers;
· Use upon corporate documents and materials of trade marks containing the numeral ‘9’ (generally accompanied by the logo of nine dots) or the word ‘Nine’ (usually as part of ‘Nine Network’ or accompanied by the logo of nine dots);
· Use of ‘Nine Access’ and ‘Powered by Nine’ in respect of the provisions of ‘strategic advisory and information services to businesses’;
· References in third party media to the Opponent as ‘Channel 9’, ‘Nine Network’ and occasionally ‘Nine’;
· The Opponent’s high viewer ratings;
· Promotion across multiple mediums such as magazines, outdoor advertising and various promotional merchandise;
· Sponsorship of numerous events, including high profile events; and
· The Opponent’s website traffic and social media presence.
I am satisfied that the Opponent’s trade marks ‘9’ and ‘Nine’ had a reputation as at the priority date, at least in respect of television broadcasting. The inquiry then is whether because of that reputation, use of the Trade Mark by the Applicant in respect of the various advertising, marketing and business services specified in the application is likely to deceive or cause confusion (confusion being a mental state which may go no further than perplexing or mixing up the minds of the purchasing public[10]).

The Trade Mark is comprised of the combination of the numeral ‘9’, the word ‘strategic’ and a device of a chevron between the words. The word ‘strategic’ in the Trade Mark describes a character or quality of the Applicant’s services (in that advertising, marketing and business services may be ‘relating to, characterized by, or of the nature of strategy’[11]). The Applicant itself states ‘9 Strategic is a marketing company that provides business advisory services, and in particular, strategic marketing services, to Australian businesses’. To that end the word ‘strategic’ carries somewhat less weight in distinguishing the Applicant’s services from those of others, although it cannot be discounted.

The numeral ‘9’ does not carry any particular significance in respect of the services (I note that the Applicant refers to ‘the 9 principles or “boxes” of strategic marketing’, however there is no evidence that this significance is known by the general public). Nor is the numeral 9 commonly used in respect of the services to indicate size, quantity, address, model number and so on (being factors which often render a numeral non distinctive). Similarly the chevron appears to be an arbitrary device with no particular significance. Accordingly these features carry greater weight in distinguishing the Applicant’s services.
At the same time, I bear in mind that the word portions of composite trade marks are generally the most important for the purposes of comparison.[12] Verbally the Trade Mark is likely to be referred to as ‘nine strategic’, and the prospect that it will be recalled as such exists. Additionally, although not strictly within the confines of a notional comparison, the chevron device is shown in the evidence to be omitted at times (such as in the article about the Applicant in BRW magazine and in the Applicant’s website address), possibly because it is not standard typeset.

A further factor informing the likelihood of confusion is the nature of the parties’ services. The reputation of the Opponent’s marks largely rests with television broadcasting. I do not equate the advertisement of those broadcasting services, nor the advertisement of programs that are broadcast, with the provision of advertising services. However the sale of advertising time, such as within specific programs or at certain times or seasons, begins to coincide with the advertising, marketing and business services of the Applicant. It is conceivable that in the sale of such advertising time, marketing advice such as which programs, times or seasons would be most effective is provided. There is at least an indication that this is indeed the case by the Opponent’s ‘Nine Access’ website and ‘Powered by Nine’ business (albeit there is little detail provided about them).
It would therefore not be unreasonable to conclude that consumers are likely to make such a connection between the services, especially where the provider is a prominent organization with many resources at its disposal, as the Opponent is.
Accordingly where the numeral ‘9’, in which the Opponent has established a reputation at least as a television broadcaster, is combined with a word which is descriptive of services that the Opponent would conceivably provide, and is combined with a graphic element that does not outweigh the other features (and which is unlikely to be referred to verbally and at times is omitted), it is likely that consumers would be caused wonder whether the Applicant’s services are provided by the Opponent.
The lack of actual confusion is not surprising, given the Applicant does not appear to have traded extensively (judged from turnover figures). Nor would I consider four years, at a relatively low volume of trade by the Applicant, a significant period of concurrent use.
I am therefore satisfied that because of the Opponent’s reputation in the trade mark ‘9’ and ‘Nine’, use of the Trade Mark by the Applicant in respect of the specified services would be likely to cause confusion. The ground of opposition under section 60 is accordingly established.
Decision and costs
Section 55 of the Act provides:
Unless the proceedings are discontinued or dismissed, the Registrar must, at the end, decide:
(a) to refuse to register the trade mark; or
(b) to register the trade mark (with or without conditions or limitations) in respect of the goods and/or services then specified in the application;having regard to the extent (if any) to which any ground on which the application was opposed has been established.
Note: For limitations see section 6.
The Opponent has established a ground of opposition under the Act. I therefore refuse to register trade mark application 1447735.
Costs generally follow the event, and given there is no apparent reason to depart from this principle I award costs against the Applicant.
