MILTON

v

MILTON & ANOR

[2022] HCASL 19
P41/2021

  1. The applicant requires an extension of time to seek special leave to appeal from part of a unanimous decision of the Full Court of the Family Court of Australia (Strickland, Aldridge and Kent JJ) to affirm the decision of the primary judge (Sutherland CJ).

  2. The application has insufficient prospects of success to warrant a grant of special leave and raises no question of principle. It would therefore be futile to grant the extension of time sought.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
