The court also recognised the possible merit in the Crown's argument and decided that the appropriate way to proceed was to grant Marsh bail and allow his appeal to take its course. The court granted Marsh bail on the conditions agreed by the parties and made the orders set out in the Short Minutes of Order dated 12 March 2021.
