The court dismissed the claim by the land agent company, Kain & Zecevich Pty Limited, as it found that the company did not rely on the respondents' conduct and did not suffer a loss "by conduct" of the respondents.

Kaze Constructions Pty Ltd was awarded judgment against the respondents for $260,000. Judgment was entered for the respondents against Kaze Constructions' related company, Kain & Zecevich Pty Limited. The question of costs was reserved for later determination. The court's findings effectively held HIA and its agent accountable for their misleading conduct, resulting in significant financial compensation for Kaze, while dismissing the claims of the related land agent company.
