The p l a i n t i f f w a s born i n ~ c c k m b e r 1937, in L o s Angeles,
United S t a t e s of America. I n 1 9 6 8 he w a s i s s u e d an e n t r y
permi t a s a v i s i t o r , e n t e r e d ~us t - r a l ' i a , registered as an
a l i e n and a p p l i e d f o r resident status., On 2 3 S e p t e h e r 1 9 7 4 ,
he was g ran ted permanent resident s t a t u s . Ae has a teenaged
s o , a c h i l d of a former ma-rriage, who l i v e s with h i m i n
A u s t r a l i a . There i s some confusion as t o the p 1 3 i n t i f f i s
precise m a r i t a l s t a t u s as a r e s u l t of u n c e r t a i n t y as t o t h e
v a l i d i t y of a Mexican ceremony t o which t h e p l a i n t i f f and a
\vomim, who was subscq l~en t ly Gescribed as h i s w i f e , were
p a r t i e s . The a s s o c i i . t i o n between t h e p l a i n t i f f and t h i s
woman ended i n 19G9. I f , a s t h e p l a i n t i f f contended, this
Mexican ceremony d i d n o t c o n s t i t u t e a v a l i d marr iage, the
p l a i n t i f f was, a t t h e t i m e of thc h e a r i n g be fo re the T r i b u n a l ,

i n the Northern T e r r i t o r y he d i d possess a p r o h i b i t e d drug,
t o w i t , c an i~ab i s . The f a c t s of t h e o f fence involvcd t h e
p l a i n t i f f i n t h e at tempted product ion, on a s u b s t e n t i a l s c a l e ,
of cannabis which was c l e a r l y in tended f o r subsequent s a l e .
