HIS HONOUR:

1 Ken Bayliss, you have pleaded guilty to seven charges of using a carriage service with respect to child pornography. Specifically, you have pleaded guilty to the following charges, all contrary to sub-s.474.19(1) of the Commonwealth Criminal Code, of using a carriage service to:

Charge 1: Transmit child pornography material between 1 June 2009 and 12 April 2010;

Charge 2: Cause child pornography material to be transmitted to yourself between 1 June 2009 and 12 April 2010;

Charge 3: Transmit child pornography material between 22 April 2010 and 6 June 2011;

Charge 4: Cause child pornography material to be transmitted to yourself between 22 April 2010 and 6 June 2011;

Charge 5: Solicit child pornography material between 22 April 2010 and 10 May 2011;

Charge 6: Make child pornography material available between 22 April 2010 and 16 May 2011;

Charge 7: Access child pornography material on 6 June 2011.

2 At the time of the offending in relation to Charges 1 and 2, the maximum penalty for offences contrary to sub-s.474.19(1) of the Commonwealth Criminal Code was imprisonment for a period of ten years.

3       In relation to Charges 3 to 7, as a result of amendments made to the legislation which took effect on 15 April 2010, the maximum penalty is imprisonment for 15 years.  

4       You are presently 39 years of age, having been born on 21 December 1972.  Over the period of this offending you were aged between 36 and 38 years.

5       I turn now to the facts.

6       The circumstances of your offending are set out more particularly in the prosecution opening tendered as Exhibit “A” and annexed to these sentencing reasons as “Annexure A”.  Your counsel accepted the opening as an appropriate factual summary for the purposes of sentencing.

7       I do not intend to re-state all those facts in full here, I accept them and incorporate them as the more particularised facts of this sentence.  They incorporate Schedule A, being particulars of Charge 5 - using a carriage service to solicit child pornography.

8       In essence, your conduct may be summarised as follows.

9       On 7 June 2011 the Australian Federal Police executed a search warrant at your home residence.  Police located a number of chat logs on a midi tower.  No images or videos depicting child pornography were located.

10      You had come to the attention of police as a result of covert police operations targeting users of a peer-to-peer file-sharing program known as Gigatribe.  Gigatribe is a file-sharing program which allows users to upload, view, and download content with other members with whom they have shared contact details.  The system allows participants the ability to share folders within the main hard drive of their computer or external removable storage devices such as a USB drive. 

11      Covert police officers obtained access to files being shared by a person using the Gigatribe username "ausyngcker”.

12      Charges 1 and 2 relate to using the internet to engage in child pornographic text conversations, pictures and videos with another, or others.  They incorporate you transmitting the material (Charge 1) and you receiving the material (Charge 2).  The conduct took the form of a text conversation known as a "chat" in which you graphically described sexual conduct with children and simultaneously transmitted and received images and videos.  The conversations were located on the midi tower computer.  The videos or images were unable to be located and their content is inferred from their file names or from the content of the conversation which occurs simultaneously with the transmission of the file.  The chats contain extremely graphic depictions of sexual activity and abuse of children as young as newborns up to those aged 15 or 16 years.  The vast majority related to children under ten years.

13      On occasions, as images and videos were viewed, simultaneously during the chats you and the other person or persons were apparently sexually gratified by making references to masturbating as you viewed the material.  Chats also took the form of role play in which you and the other party to the conversation illustrated sexual activity you would like to perform with children. 

14      Sexual activity depicted in the chats included the following: 

·     masturbation of children;

·     you exposing your penis and masturbating in front of children in public toilets and at beaches;

·     vaginal and anal penetration of children including fellatio and cunnilingus;

·     urinating into the anus, vagina and mouth of a child and defecating into mouths of children;

·     violent gang rape of children;

·     cutting off body parts, burning with cigarettes, ‘impaling’ a child on your penis and breaking the neck of this child during sexual activity;

·     watching children engaged in sexual acts with dogs;

·     deliberately infecting children with the HIV virus

·     drugging children to facilitate their abuse;

·     killing a sexually abused child and cooking and eating their flesh;

·     engaging in sexual activity with unconscious or deceased children.

15      Once a mutual interest in sexual activity with children was established you often expressed your preferred age of children with whom you desired sexual activity or victims you wished to see in child pornography materials by using expressions such as "0+", "I go as low as 0", "love pre-teen."

16      During the charge period of these chats there were 332 chats in which texts depicting sexual activity with children were transmitted by you and 971 files containing images and video were transmitted by you.  Over the same period you caused 228 text depictions and 1,012 files to be received by you. 

17      The chats revealed the existence of an informal network of individuals located in various parts of the world.  Many communicated regularly with you and some appeared to hold you in high esteem because of your ability to compose descriptions of extremely graphic and violent sexual acts and for your collection of child pornography.

18      Charges 3 and 4 reflect the same conduct as Charges 1 and 2 but form the basis of separate charges because of legislative changes over the period of offending.  As from 15 April 2010 the maximum penalty increased from ten to 15 years' imprisonment.  Throughout the period encompassed in Charges 3 and 4 you transmitted 528 files of images and video and 228 texts of child pornography, and caused to be received by you 642 files of images and video and 228 texts of child pornography.

19      The prosecution accepts that there was some overlap in files being transmitted or received on more than one occasion.  Particulars of the extent of overlap were set out in Exhibit “C”.

20      Charge 5 reflects your conduct in seeking more child pornography from others.  It is expressed as soliciting and occurred on 21 separate occasions over a period of 13 months from 18 separate persons.  Extracts of the conversations relating to the soliciting are contained in Schedule A to the Crown opening (Exhibit “A”).

21      Charge 6 represents your conduct in making child pornography available.  During the chats you made reference to concealing your collection and that it was stored on an external USB device.  The police were unable to locate the device on which the shared files were physically stored.  The files had been shared through the peer-to-peer file-sharing program Gigatribe. 

22      Although none of the files that were shared by you with others using Gigatribe could be recovered by police, three images were downloaded by an undercover police operative between 6 January 2011 and 16 May 2011.  These depicted a pre-pubescent male child being anally penetrated, a pre-pubescent female child touching her genitals and a sleeping pre-pubescent male child with his penis exposed.  You also told the undercover operative in the chat that you liked kids 0 to 10 years.

23      Charge 7 represents your conduct in accessing child pornography in the form of written narrative.  The narratives consisted of five stories depicting, in highly explicit detail, sexual intercourse between adults and children aged between 3 and 14 years.  The sex involved vaginal, anal and oral penetration accompanied by strong themes of incest, and in some circumstances the use of force.  Examples of names of the documents included "Incest Tales - Little Billy's First time", "Incest Tales - I Meet Grandad" and "Family Nudist Beach."

The document entitled "Incest Tales - Little Billy's First time" is written from the perspective of an 8-year-old who relates his first sexual appearance when he was five years old.  It describes the child performing fellatio on his father, the father then penetrating the child's anus with his fingers and penis while the child has his hands and feet tied with rope.  He continues to the point where the child is made to inhale a substance which causes him to become easier to be anally penetrated.  The child is then simultaneously penetrated by his father and grandfather.         

25      You participated in interviews with police at your residence and subsequently at Australian Federal Police headquarters on 7 June 2011.  In both interviews you denied the offending.  You also said that since your last conviction you had not viewed child pornography because it was not worth the risk.

26      On 26 March 2012 you were committed for trial in the County Court after entering a plea of guilty to the seven charges the subject of the indictment.

27 On 19 August 2004 you were sentenced at the Magistrates' Court, Melbourne, to a term of imprisonment of eight months to be served by way of Intensive Correction Order for the possession of child pornography contrary to s.71 of the Crimes Act 1958. You had been found in possession of 800 images and 3,062 text files constituting child pornography. As a result of this conviction your name was placed on the Sex Offenders Register on 19 August 2004 for a mandatory period of eight years.

28      Following your arrest you were remanded in custody and released on bail on 9 June.  You have therefore spent three days in custody.

29      I now turn to your personal circumstances.

30      As noted earlier, you are presently 39, and over the period of this offending you were aged between 36 and 38 years. 

31      You were educated to Year 12 level by the age of 18.  You have described yourself as an average student.  After leaving school you obtained work as a sales assistant, then administrator with a department store over a period of 11 years.  You have participated in further study in computing but your degree remains incomplete.  You worked as a computer consultant through a company attached to Telstra for two and a half years, then became a help desk analyst and team leader with a confectionary company.  Your most recent position has been in local government where you have been employed as a business consultant, assisting the council to improve its customer service.  You were put on leave following being charged but that position was terminated and you are effectively now unemployed.

32      You are the youngest of four children.  You are the only son and have two surviving sisters as well as a half-sister.  One sister died tragically from leukaemia when you were in your early 20s and another has distanced herself because of your sexual fantasies with nephews.  Your remaining sister is supportive of you whilst acknowledging your acts as sickening and reprehensible.  Your father is deceased but you remain on good terms with your mother, who I understand is not aware of these charges.

33      You have described your upbringing in mixed terms.  On the one hand you have said that your childhood was happy and that you enjoyed a good relationship with your mother and grandmother, but on the other hand you said that you had felt alienated and different from your family from early in your childhood.  You said you had little in common with your father.

34      You experienced social problems at school involving repeated bullying and ostracism.  You were teased about being gay.  You realised that you were homosexual in your early teens and your first sexual experiences were with men you had met in casual contexts.

35      You have had three major personal relationships, between 1995 and 1997, from 2000 to 2010 and from 2010 until the present.  Your current partner is shocked but supportive of you.

36      A number of reports have been tendered on your plea. 

37      Your general practitioner, Dr Choong, has reported various illnesses, significantly, a stroke in 2004, asthma and HIV in 2009 and later respiratory disease.  You receive daily medication for both the asthma and HIV.  Further updated reports dated 2 August and 21 August 2012 record the recent exacerbation of your respiratory illness and diagnosis of bronchiectasis, as well as a detailed history of your many visits to Dr Choong throughout 2011.  These visits are consistent with health reasons accounting for occasional absences from participation in the voluntary Sex Offender Program with Mr Matthew Barth, who is your treating counsellor for this program.

38      Dr Lester Walton, forensic psychiatrist, had reported in July 2004, following your earlier offending.  Dr Walton's report was tendered on your plea on the current offending as background.  In 2004 Dr Walton's only diagnosis was of chronic dysthymic disorder, that is, low grade depression, and he doubted that sex offender rehabilitation was required, suspected that you fell into a reasonably favourable category in relation to recidivism and thought that actual incarceration would not be required in order to achieve specific deterrence benefit.

39      Mr Patrick Newton, forensic and clinical psychologist, carried out a comprehensive psychological evaluation on 26 April 2012, after you had participated in 22 counselling sessions with Mr Matthew Barth, probationary psychologist and associate with Mr Newton, between 25 August 2011 and 6 August 2012.  The sessions with Mr Barth were directed towards a Sex Offender Treatment Program.

40      Mr Newton also gave evidence on your plea.

41      In Mr Newton's written opinion you suffer the following: 

·     high reactive stress to your current legal predicament;

·     underlying depression and anxiety flowing from long-standing emotional difficulties and HIV diagnosis;

·     low self-esteem;

·     

feelings of pessimism, inadequacy, hopelessness and physical and mental exhaustion.        

42      More specifically, as to your sexual expression, it is Mr Newton's opinion that you have directed your anger over your HIV infection outwards towards others, firstly to God, the universe or fate, secondly, to sexual fantasy.  This is manifested in a compulsive tendency to act out your anger in fantasy by engaging in repeated thoughts and behaviours that emphasise either your position as a powerful protagonist in the violation of others, hence compensating for your intrinsic sense of powerlessness, or that embrace your powerlessness in subjugating yourself to the desires and depredations of others.

43      In Mr Newton's opinion these thoughts underpin your engagement with violent, sadomasochistic and child pornographic material.  Such fantasies in more depraved and immoral topics have become increasingly entrenched as parts of your sexuality.  A key focus has been on depictions where extreme expressions of power and dominance are central, with you experiencing greater arousal when the power differential between the protagonists was increased.

44      Mr Newton opines that you suffer from an unequivocal psychosexual pathology of serious proportions, meeting diagnostic criteria for "paraphilia not otherwise specified" by DSM4 criteria, and assessed your degree of risk of recidivism as at least in the moderate to high risk range.  There is a continued need for intensive professional treatment to address your psychosexual issues.  You have expressed an openness to pursue further treatment as required.

45      Mr Newton expanded on his report when giving evidence on the plea.  Mr Newton said:

·     you were open to pursue further treatment but undoubtedly continue to have a strong dynamic in your sexuality around issues of power and dominance which persist notwithstanding this prosecution and treatment so far.

·     your expressions of sense of shame over your conduct are part of a complex compulsive cycle in which you engage where you feel guilt, shame and rejection of the material, which feeds upon further bad feelings, depression, poor self-esteem and a sense of having failed, which you then seek to escape by retreating into the masturbatory cycle involving power and dominance, leading to a repetition of the offending behaviour.

·     since your diagnosis of HIV you have felt a greater anxiety and depression over a persisting low level of depression of many years.  Mr Newton expressed this as multiple layers of dysphoria, represented by chronic lowered mood.  A large part of your anxiety and depression is reactive to your current legal predicament, however.

·     whilst respecting Dr Walton's diagnosis, Mr Newton preferred a diagnosis of an adjustment disorder with mixed disturbance of emotion and mood.  This means you are having a reaction to identifiable stressors.  Mr Walton posited that your current presentation is consistent with the ongoing outworking of dysthymic disorder. 

·     your paraphilia is a sexually deviant disorder with lack of control and persistence despite extremely negative personal consequences.  DSM4 does not include specific categories to cover internet-based behaviours and there is still considerable debate within the professions regarding the validity of those diagnoses.  Your paraphilia is fantasy-based in the sense that the diagnosis does not imply any belief that your comments in the chats have been acted upon by actual offending against real children. 

·     however, the fact that you frequently carried your fantasies into your own engagement in adult sexual activity significantly increases your risk of recidivism.

46      Mr Barth reported on your participation in the Sex Offender Program.  The program is being directed to coping and mood management skills, understanding the destructive impact of child pornography in all its forms, addressing your avoidant interpersonal approach to intimate relationships and relapse prevention training.

47      Despite an improved level of insight into emotional triggers and factors that contributed to your offending, your progress in the program has been described as limited.  This results from your entrenched psychological issues.  Mr Bath concludes that there is an unequivocal need for you to engage in further treatment to enable you to make the appropriate behavioural changes in your life.  I accept that your earlier absences from appointments with Mr Bath were due to your recurring medical issues.

48      Character references were received from your sister Caroline, and a good friend, Mr Bates.  Each of them refers to your kindness and generosity, your willingness to engage in therapeutic recovery, and Mr Bates refers to the shame that you feel and have expressed.  Each has also expressed their continued support for you.

49      A request was made for assessment for your suitability for a Community Correction Order and the report is favourable.  I am concerned, however, at the apparent lack of detailed analysis in the report and consider that the assessment of you being a "low risk offender" is inconsistent with the full circumstances of your case.

50      A report on your suitability for the Sex Offender Program with Corrections Victoria was also received, authored by a Ms Elle Gianvanni, Senior Forensic Psychologist.  The report is comprehensive, and you are considered suitable for sexual offence specific treatment, either in the community or prison-based.  I note that the report is consistent with other assessments of your condition in that your use of pornography has been like an addiction, although problematic in phases rather than all the time, that you re-commenced viewing child pornography after your diagnosis with HIV in 2008 and that as the viewing progressed you needed more violence for arousal.  Your preference became for male children, with a younger preference when violence was involved.  You said that 15 to 16 year olds became as “vanilla” and were not as exciting.

51      Referring to the discussions you said the "more depraved, the more exciting it got."  The writer of the report considered that your habituation to sexual images, and the tendency for the material to become “vanilla”, indicates that over time, without intervention, material will become increasingly explicit.  Despite your participation so far in therapy, the writer believed that you currently continue to lack appropriate strategies to managing your offending.  In the writer's opinion your behaviour and fantasies meet the diagnostic criteria of the DSM4 paedophilia, sexually attracted to males, non-exclusive type, where "non-exclusive" indicates a sexual interest in adults also.

52      The conduct in which you engaged constitutes serious child pornography and follows a conviction and sentence in 2004 of eight months' imprisonment by Intensive Correction Order for possession of child pornography.  The images were deliberately concealed on a remote device to avoid detection and have never been recovered. 

53      General deterrence and denunciation are paramount considerations.  Specific deterrence assumes greater focus because of your earlier offending and the fact that your conduct on these occasions concerned the transmission and receipt of the material with others, which was a significant further step in culpability, beyond the mere possession for which you were sentenced in 2004.

54      

The nature of the text conversations contains many examples of descriptive child pornography at a grossly depraved and sickening level.  Although it might be accepted that the descriptive pornography does not carry with it the immediacy of exploitation of children involved in a photographic image, it served to support and encourage that wicked exploitation.            

55      Whilst the depth of depravity of the pictorial nature of the images (other than the three downloaded by the police) cannot be precisely ascertained because they were never able to be located, their content can be inferred to a certain, but limited, extent from other known facts, such as the nature of the conversations in the “chats”, the file names, the nature of your dark sexual interests as disclosed to Mr Newton, Mr Barth and Ms Gianvanni and the three images downloaded by the undercover operative.  One of those images was of a pre-pubescent male child being anally penetrated.

56      I am satisfied beyond reasonable doubt that images were contained in the material representing child pornography at a very serious level.

57      In mitigation I have taken into account the matters urged upon me by your counsel, including the following: 

·     Charges 1 to 4 effectively represent one course of continuing conduct and you should not be penalised twice for outgoing text and incoming text. 

·     As to the number of transmissions, there has been significant overlap in the material between the charges.  

·     Not all of the texts discovered in the midi tower involved child pornography. 

·     Whilst the images may be inferred to be at a very serious level, the very worst type of image cannot be inferred from the discussions because of the reasonable possibility of fantasy-based expression. 

·     The guilty plea was made at the earliest practical stage and there was no contested committal.  Furthermore, the plea of guilty avoided what could have been a protracted trial on what inferences could be drawn from various labels to files.

·     The plea of guilty is itself indicative of some remorse, as are your expressions to your counsellors and Mr Bates. 

·     The loss of your employment as a result of your offending.

·     Your ill-health, particularly HIV diagnosis and its effect in exacerbating your anxiety and underlying mood, making you more vulnerable to express your paraphilic disorder.  In my view this is a relevant context to your offending.

·     Your paraphilia, which I accept is an underlying disorder of compulsion, impairing your ability to make calm and rational choices, dis-inhibiting you and in that way contributing causally to the commission of your offences.

·     Your physical illnesses referred to by Dr Choong and your reactions to HIV medications, all of which will make a term of imprisonment more difficult for you than upon an offender in normal health.

·     That you have genuinely sought and persisted with treatment for your disorder since having been charged.  I accept that the disruption through missed appointments was due to illness.

·     Your experience in being in remand custody for three days before bail.

58      Despite the work you have so far undertaken in therapy, based on your re-offending, your personality disorder and the conclusions reached by Mr Newton and Ms Gianvanni, in my view your prospects of rehabilitation must be regarded as low. 

59      Your sister has written of your high intelligence and employment capacity.  You have an excellent employment record.  Throughout the period of offending you have managed a position with the City of Melbourne as a senior business consultant in a customer-focused role, earning approximately $85,000 gross per year. 

60      Although I have accepted that your personality disorder impaired your ability to make calm and rational choices, you had the insight to understand the effects of child pornography, you had a clear understanding of the consequences of engaging in child pornography from your conviction in 2004, but re-offended nonetheless.

61      The authorities require that I take into account those who are harmed by the production of child pornography images.  The fact that persons are prepared to possess and access child pornography necessarily creates a market for the corruption and exploitation of children.  The accessing of child pornography and its possession, quite rightly outrages the Australian community and usually calls for condign punishment by way of immediate imprisonment. 

62      We live in a global community, and the internet being what it is superficially masks the deep personal viciousness of this form of exploitation of children.  Children, anywhere in the world, should be afforded protection and any notion of apparent justification by a sense of removal by distance or effect is misconceived, and in essence simply an exercise in wilful blindness.

63      Your offending persisted over a period of two years and embraced a variety of aspects of child pornographic activity: accessing, soliciting, making available to others, transmitting and receiving.  It embraced serious levels of depravity.  You operated within a wide international network, encouraging this type of activity with a degree of sophistication, including the concealment of your material.  Some of the chats indicated a contempt for the lawful regulation of this type of offending.

64      Balancing as best I can the various sentencing considerations, in particular the matters set out in 16A of the Crimes Act 1914 (Cth), and after having considered all other available sentences, I am satisfied for the reasons expressed that no sentence other than a term of imprisonment is appropriate. I propose to sentence you to serve a term of imprisonment with a minimum period before being eligible for parole.

65      Mr Bayliss, would you please stand.

66      Whilst it may be therapeutically more desirable that your participation in the Sex Offender Program be outside a custodial environment, I do not accept that the gravity of your offending, in all the circumstances of the case, permits such disposition in balancing the various sentencing considerations.

67      On Charge 1, use a carriage service to transmit child pornography material, you are convicted and sentenced to two and a half years' imprisonment.  That sentence commences today.

68      On Charge 2, use a carriage service to cause child pornography material to be transmitted to yourself, you are convicted and sentenced to two and a half years' imprisonment.  That sentence commences today.

69      On Charge 3, transmit child pornography material using a carriage service, you are convicted and sentenced to two and a half years' imprisonment.  That sentence commences today.

70      On Charge 4, cause child pornography material to be transmitted to yourself using a carriage service, you are convicted and sentenced to two and a half years' imprisonment.  That sentence commences today.

71      On Charge 5, solicit child pornography material using a carriage service, you are convicted and sentenced to two years' imprisonment.  That sentence commences ten months after the commencement of the sentence on Charges 1, 2, 3 and 4.

72      On Charge 6, make child pornography material available using a carriage service, you are convicted and sentenced to two and a half years' imprisonment.  That sentence commences ten months after the commencement of the sentence on Charges 1, 2, 3 and 4.

73      On Charge 7, access child pornography material using a carriage service, you are convicted and sentenced to one year’s imprisonment.  That sentence commences 30 months after the commencement of the sentence on Charges 1, 2, 3 and 4.

74      The total effective sentence is three and a half years' imprisonment.

75      I order that you serve a period of two years before being eligible for parole. 

76      The effect of the sentence is that:

(a)      it will entail a period of imprisonment of not less than the non-parole period, which is two years, and if a parole order is made releasing you from prison on parole it will entail a period of service in the community, called a parole period, to complete the service of the sentence; and

(b)      if a parole order is made releasing you from prison, the order will be subject to conditions; and

(c)      the parole order may be amended or revoked, and

(d)      the consequences if you fail, without reasonable excuse, to fulfil those conditions are that your parole may be revoked and you may be required to serve the full term of your sentence.

77 I declare that the sentence of imprisonment that I have imposed commences this day and, pursuant to s.16E of the Crimes Act 1914 (Cth) and s.18(4) of the Sentencing Act 1991 (Vic), I declare that the period of three days be reckoned as time already served under this sentence and I direct that the fact of this declaration and its details be noted in the records of the court.

78      I recommend that while in custody you be assessed for participation in the Sex Offender Program. 

79 Pursuant to s.6AAA of the Sentencing Act 1991 (Vic), but for your plea of guilty the sentence that would have been imposed is a total effective sentence over all charges of four years and four months’ imprisonment with three years to be immediately served.

80      Now there is another matter that I need to attend to.  You may be seated for the moment, Mr Bayliss. 

81      Mr Bayliss, I also need to speak to you about the provisions of the Sex Offender's Registration Act 2004 (Vic).  You are already aware of that Act.  The offences to which you have pleaded guilty are registrable offences pursuant to the provisions of that Act, and by reason of your convictions for these offences you are a registrable offender obliged to comply with the reporting obligations imposed by that Act.

82      In sentencing you I have ignored any consequences that may arise and in this case do arise under that Act from the imposition of the sentence today.  In other words the reporting burden that you carry as a registered offender is not a matter that can objectively influence the imposition of a just sentence. 

83      Further, pursuant to s.50 of the Sex Offender's Registration Act I am required to give you written notice of your reporting obligations and the consequences that may arise if you fail to comply with those obligations.  I am also required to inform you of the length of your reporting period, which in your case is for life.

84      My Associate will shortly hand you the Notification Of Reporting Obligations which I have already signed.  Your representative in court today will ensure that you understand the requirements set out in this form and I will ask you, once it is given to you, to sign the Acknowledgement that you have received the Notification form and return the Acknowledgement to my Associate. 

85      I will now have the appropriate forms for the Sex Offender's Registration passed to you.

INDICTMENT

1. The Indictment contains the following 7 charges:

   I.Use a carriage service to transmit child pornography material contrary to subsection 474.19(1) of the Criminal Code (Cth)

   II.Use a carriage service to cause child pornography material to be transmitted to himself contrary to subsection 474.19(1) of the Criminal Code (Cth)

   III.Transmit child pornography material using a carriage service contrary to subsection 474.19(1) of the Criminal Code (Cth)

   IV.Cause child pornography material to be transmitted to himself using a carriage service contrary to subsection 474.19(1) of the Criminal Code (Cth)

   V.Solicit child pornography material using a carriage service contrary to subsection 474.19(1) of the Criminal Code (Cth).

   VI.Make child pornography material available using a carriage service contrary to subsection 474.19(1) of the Criminal Code (Cth).

   VII.Use a carriage service to access child pornography material contrary to subsection 474.19(1) of the Criminal Code (Cth)

FACTS

1. On 7 June 2011 the Australian Federal Police (AFP) executed a search warrant at the residence of the offender.  Police located a number of chat logs on the midi computer tower.  No images or videos depicting child pornography were located.  Police seized the midi tower computer and a number of other electronic storage devices for analysis.

2. The offender had come to the attention of police as a result of the activities of a covert police operative from the AFP High Tech Crime Internet Policing Team who was targeting users of the peer-to-peer file sharing program GigaTribe.  GigaTribe is a file sharing program which allows users to upload, view and download content with other members with whom they have shared contact details.  The system allows participants the ability to share folders from within the main hard drive of their computer or external, removable storage device such as a USB drive[1].  The covert police officer obtained access to files being shared by a person using the GigaTribe username “ausyngcker”.

3. At the time of his arrest the offender maintained a DSL internet account with the Internet Service Provider (ISP), Exetel.

Charge 1
Use a carriage service to transmit child pornography between 1 June 2009 and 12 April 2010: ss.474.19(1)(a)(iii) Criminal Code

1. The evidence relied upon in support of this charge falls into 2 categories.

a)The content of the online chat logs (generated using a variety of chat programs) in which the offender graphically described sexual activity involving children;

b)Transmission of images and videos whose content is inferred from:

i)their file names; or

ii)from the content of the chat which occurs simultaneously with the transmission of the file. 

1. Police located a large number of conversations stored on the midi tower computer[2].  These conversations were records of online chats in which the offender had participated using the programs Skype, GigaTribe, Yahoo!7 Messenger and Windows Live Messenger.  These programs permit users to engage in text based chats with two or more people.  Some also permit users to engage in voice and video communication with the use of a webcam.  Users can also transfer and receive files during the course of such chats. 

   [2]The content of the chats, conducted using various programs, was merged into a single Excel spreadsheet comprising approximately 98,000 lines of text.  Given its size this document has not been produced in hardcopy.

2. When using GigaTribe the offender employed the usernames “ausyngfcker”, for Skype “raunch4young” and for Yahoo!7 Messenger he used “bbraunch4young”. 

3. The chats contained extremely graphic depictions of sexual activity and sexual abuse of children as young as newborns up to those aged 15 or 16 years.  The vast majority related to children aged under 10 years.

4. The sexual activity depicted in the chats[3] included the following acts:

   [3]Police extracted relevant portions of the chat which were produced in a Word document produced a compact disc annexed to the statement of RYAN. 

   -masturbation of children;

   -the offender exposing his penis and masturbating in front of children in public toilets and at beaches;

   -vaginal and anal penetration of children including fellatio and cunnilingus;

   -urinating into the anus, vagina and mouth of a child and defecating into mouths of children;

   -violent gang rape of children;

   -cutting off body parts, burning with cigarettes, ‘impaling’ a child on his penis and breaking the neck of this child during sexual activity;

   -watching children engaged in sexual acts with dogs;

   -deliberately infecting children with the HIV virus[4];

   [4]The offender is HIV positive. 

   -drugging children to facilitate their abuse;

   -killing a sexually abused child and cooking and eating his/her flesh;

   -engaging in sexual activity with unconscious or deceased children.

10.The topic of his interest in child pornography was frequently raised by the offender where he stated he was a pedo or that he was interested in no limits raunch and filth[5].  Once a mutual interest in sexual activity with children was established the offender often expressed his preferred age of children with whom he desired sexual activity or victims he wished to see in child pornography material by using expressions such as:

11.The nature of the sexual activity described was communicated by the use of expressions such as:

-i love watching babies getting molested or would love to molest one with you;

-FACE FUCK THE LITTLE KID UNTIL HIS FACE TURNS BLUE;

-love to fuck any small hole and love fuckin kids

-get balls deep

-rape the boy in front of his dad

-I SO WANNA SNUFF A BABY

-gonna stab him up his rectum

-love to infect kids too

-rape is rape, although the younger the hotter

Many of the chats took the form of a role play in which the offender and the other party to the conversation illustrated sexual activity that they would perform with children.  The offender also related instances where he claimed to have engaged in sexual activity with children to whom he had access when he was babysitting or from other pedos who had made their children available to him. 

12.During the charge period there were 332 chats in which text depicting sexual activity with children was transmitted by the offender.

13.The offender also transmitted images and videos during online chats.  None of these files were located by police and therefore the content of these files is inferred from the individual file names or the content of the chat during which transmission occurred.  On occasion pictures and videos were viewed simultaneously during the chats and the offender and the other person/s were apparently sexually gratified by making references to masturbating as they viewed the material.

14.Some of the files transmitted were named.

15. During the charge period 971 files (pictures and videos) were transmitted by the offender.  The chats revealed the existence of an informal network of individuals located in various parts of the world.  Many communicated regularly with the offender and in some cases held him in high esteem because of his abilities to compose descriptions of extremely graphic and violent sexual acts and also for his collection of child pornography.

Charge 2
Use a carriage service to cause child pornography to be transmitted to himself between 1 June 2009 and 12 April 2010: ss.474.19(1)(a)(ii) Criminal Code

16.The evidence in support of this charge is as described above (for charge 1) with the exception that this charge captures the conduct of other persons with whom the offender chatted online.  Therefore, a single online chat involves conduct of the offender and that of the person participant in the chat who also writes depictions of sexual activity with children. 

17.For example the following was typed by persons other than the offender in response to his comments.

-sometimes you just gotta empty your balls;

-I’D LOVE TO BANG ITS HEAD AGAINST A WALL, MAN

-Would fuckin luv to share a yng one with you, no limits

-love to train kids to suck on logs like candy

-love to pump my load into a slut like that

-Do they cry when you suck them or do they giggle?

18.The offender also caused image and video files to be transmitted to himself in the course of chatting to others.  These files were not located by police.

19.During the charge period, the offender caused 332 depictions of text-based child pornography and 1,012 files (pictures and videos) to be transmitted to himself. 

Count 3
Transmit child pornography using a carriage service between 22 April 2010 and 6 June 2011: ss.474.19(1)(a)(iii) Criminal Code

20.This charge is necessitated by the commencement, on 15 April 2010, of the Crimes Legislation Amendment (Sexual Offences Against Children) Act 2010 which amended subsection 474.19(1) of the Criminal Code (Cth). As a result of the amendment, the maximum applicable penalty for offences against this provision increased from 10 to 15 years. The offending which is the subject of charge 1 above continued beyond 15 April 2010.

21.During the period 22 April 2010 to 6 June 2011, the day prior to his arrest, the offender transmitted 528 files (pictures and videos) and 228 text based depictions of child pornography.

Count 4

Causing child pornography to be transmitted to himself using a carriage service between 22 April 2010 and 6 June 2011 contrary to s.474.19(1)(a)(ii)

22.This charge is also necessitated by amendments to subsection 474.19(1) which commenced on 15 April 2010.

23.The offender continued to cause child pornography to be transmitted to himself in the manner described for charge 3.  During the charge period he caused 642 files (pictures and videos) and 228[6] text based depictions of child pornography to be transmitted to himself. 

[6]These are the same online chats referred to in charge 4 with the exception that for this charge words typed by persons other than the offender are caught. 

24.As noted previously the online chats are the subject of charge 3 are also relied upon in support of this charge although it is what was typed by the other party to the conversation which forms the basis of the criminal conduct. 

Count 5
Soliciting child pornography between 22 April 2010 and 10 May 2011: ss.474.19(1)(a)(iv) Criminal Code

25.  In the course of online chats the offender solicited child pornography by specifically requesting files (image and video) from others.  During the charge period the offender solicited child pornography on 21 separate occasions from 18 separate persons.  For an offence of soliciting child pornography to be committed it is not necessary for the offender to have received any material in response to his request. 

26.  Extracts of these conversations are contained Schedule A to the Crown Opening. 

Charge 6
Making child pornography available using a carriage service between 22 April 2010 and 16 May 2011: ss.474.19(1)(a)(iii) Criminal Code

27.As stated above, police were unable to locate the external hard drive on which files shared via GigaTribe were physically stored[7].  During the chats the offender made references to storing his collection of child pornography on an external USB device.  He also referred to the importance of concealing his collection.  The following are examples of comments made regarding the concealment of his collection of child pornography.

28.Although none of the files shared by the offender via GigaTribe were able to be seized by police, 3 images were downloaded by an undercover police operative between 6 January 2001 and 16 May 2011[12].  These depicted a pre-pubescent male child being anally penetrated, a pre-pubescent female child touching her genitals and a sleeping prepubescent male child with his penis exposed.  The officer accessed these files from the shared folder entitled !GR after the offender provided his password “yng”[13].  The Accused also told the police officer that he like kids aged 0 to 10 years.

29.Under the GigaTribe username “ausyngfcker” and within a folder entitled “!GR” 10,923 image and video files were found to be shared.  The file names of many of these appear to describe their content.  These were files were divided into in 39 separate sub-folders according to type of child pornography they contained.  For example, it may be inferred by reference to the file names that sub-folders entitled:

! GR\ACT B-G contained files depicting boys and girls;

! GR\ACT B-YB contained files depicting boys with young boys;

! GR\ACT M-B contained files depicting men and boys.

! GR\ACT M-YB contained filed depicting men with young boys

30.The offender often referred to his GigaTribe collection during a number of online chats. 

31.Access to the folder “! GR” was only possible with a password.  On occasion he recommended GigaTribe as suitable tool for exchanging child pornography because it was encrypted.  During one Skype chat with the username bigoletbear on 19 January 2011 the offender conveyed instructions on installing and configuring GigaTribe and to on how to search for child pornography using search terms such as “yng” and “perv”. 

32.Many of the files which the offender transmitted and caused to be transmitted to himself were also stored within the GigaTribe program.

Charge 7

Use a carriage service to access child pornography material on 6 June 2011: ss.474.19(1)(a)(i) Criminal Code

33.After an analysis of the midi computer tower police located 5 written stories[14] explicitly depicting sexual activity with children which had been access from a website on 6 June 2011.  These narratives depicted, in highly explicit detail, sexual intercourse between adults and children aged between 3 and 14 years.  The sexual intercourse involved vaginal, anal and oral penetration accompanied by strong themes of incest and in some instances the use of force.  The documents were entitled, for example, INCEST TALES: LITTLE BILLY’S FIRST TIME, INCEST TALES…. I MEET GRANDDAD and …….FAMILY NUDIST BEACH.

34.By way of example, the document entitled INCEST TALES: LITTLE BILLY’S FIRST TIME is written from the perspective of an 8 year old child who relates his first sexual experience when he was 5 years old.  It describes the child performing fellatio on his father, the father then penetrating the child’s anus with his fingers and penis while the child has his hands and feet tied with rope.  It continues to a point where the child is made to inhale a substance which caused him to feel woozy and dizzy while also making it easier for him to be anally penetrated.  The child is then simultaneously penetrated by his father and grandfather. 

INTERVIEWS WITH POLICE

35. The offender participated in interviews with police firstly, at his residence and subsequently at the AFP Headquarters.  In both interviews he denied the offending.

·     stated that his user account on his midi computer tower was password protected;

·     denied knowledge of the GigaTribe username “ausyngfcker” which was located by police on the chat logs stored on his computer;

·     said he had never given his passwords to anyone else.

He again denied the offending and told police that:

·he was employed by the Melbourne City Council in looking at new technology like Twitter and that sort of thing for dealing with customers [Q41];

·he owned the midi computer tower and had owned it for over a year.  [Q65 – 67];

·his computer logon name is “ken” the password for which is “advant72” [Q74 - 76];

·he used Twitter, Facebook and Skype [Q104 -105];

·he stored movies, television shows and some gay pornography on the external hard drives [Q112];

·his Skype username was “kendoll melb” [Q123];

·he installed GigaTribe about 2 years ago and that he used it mostly for sharing television shows and movies.  He only used GigaTribe once a month and his username was “ken doll Melb” [Q141 – 151];

·he did not know anything about the GigaTribe username “ausyngfcker” and was surprised to hear that chat logs with this username were located on his computer [Q152 – 158];

·since his last conviction he had not viewed child pornography because it’s not worth the risk basically.  [Q189 - 191]

·he had shared adult pornography via GigaTribe.

·the reason police were unable locate the “kendoll” user account on GigaTribe was because he had reformatted his computer about 2 months ago.  [Q205 – 208]

·he had not used GigaTribe for about 3 months and did not use GigaTribe in May [of 2011]  [Q210 – 214, 246 - 247];

·in the course of exchanging adult gay pornography with others he may have come across a couple of files depicting child pornography [Q233];

·when storing adult pornography he sometimes named folders where the name commenced with an exclamation mark [Q281];

During the interview when it was put to him that a police operative had downloaded 3 images 3 child pornography images the GigaTribe user account “ausyngfcker” he again stated that “ausyngfcker” was not him.  [Q175 - 177]

COMMITTAL

36. On 26 March 2012 the Accused was committed for trial in the County Court after entering a plea of guilty to the 7 charges the subject of the indictment. 

PENALTIES

37. At the time of the offending in relation to charges 1 and 2 the maximum penalty for offences contrary to subsection 474.19(1) of the Criminal Code (Cth) was imprisonment for a period of 10 years.

38. In relation to charges 3 to 7 all of which also relate to offences against subsection 474.19(1) of the Criminal Code (Cth), the maximum penalty is imprisonment for 15 years. This increase in the penalty was the result of amendments made by the enactment of the Crimes Legislation Amendment (Sexual Offences Against Children) Act 2010 which commenced operation on 15 April 2010.

OTHER

Previous conviction

39.On 19 August 2004 in the Melbourne Magistrates' Court the offender was sentenced, after a plea of guilty, to a term of imprisonment of 8 months to be served by way of an Intensive Correction Order for the possession of child pornography contrary to s.71 Crimes Act 1954 (Vic).  He had been found in possession of 800 images and 3062 text files constituting child pornography.  As a result of this conviction the offender’s name was placed on the Sex Offender’s Register[17] on 19 August 2004 for a mandatory period of 8 years.

Pre-sentence custody

40. The offender was arrested and interviewed on 7 June 2011 and was granted bail on 9 June.  He has therefore spent 2 days in custody.
