The Court was also required to determine whether the Uniform Civil Procedure (Fees) Regulation 1999 (Qld) and Uniform Civil Procedure Rules 1999 (Qld) were applicable in the Court of Disputed Returns. The Court of Appeal held that s 130(3)(b) of the Electoral Act 1992 (Qld) was a mandatory requirement of an effective application. However, the Court found that the circumstances gave rise to an inference that $400 of the $502.50 payment was appropriated to the required deposit. The Court held that the Uniform Civil Procedure (Fees) Regulation 1999 (Qld) and Uniform Civil Procedure Rules 1999 (Qld) did not apply to proceedings in the Court of Disputed Returns. The Court of Appeal allowed the appeal, set aside the orders made by the primary judge, and dismissed the applications filed by the Electoral Commission of Queensland. The Court ordered that the Electoral Commission of Queensland pay Caltabiano's costs of and incidental to the appeal.
