CaseChat Overview and Summary
The primary legal issue before the court was the determination of the costs and disbursements to be paid by the defendant to the plaintiff. The court was tasked with assessing the joint memorandum submitted by the parties on 15 May 2023, which outlined their agreement on the amount of costs and disbursements to be awarded. The court needed to consider whether the agreed amount was reasonable and appropriate given the nature and extent of the litigation.
The court accepted the joint memorandum as reflecting the agreement of the parties on the costs and disbursements. Gwyn J ordered that the defendant pay the plaintiff costs in the sum of $40,988.50, along with disbursements of $10,864.60. The court's decision was based on the consent of the parties, and no further argument or evidence was required. The judgment reflects a resolution of the financial aspects of the litigation between the parties.
