JUDGMENT OF THE COURT
A Leave to appeal is granted.
B The approved grounds are:
[1]Whether a decision by a trial judge to proceed with 10 jurors is amenable to examination on an appeal.
[2]If so, whether the Judge’s decision in this case rendered the trial a nullity.
[3]Whether the Judge’s directions to the jury in respect of the defence of provocation were erroneous.
[4]Whether the Judge’s directions to the jury in respect of statements by the deceased to Crown witnesses were erroneous.
