Introduction
[1] By originating application dated 15 December 2021, and pursuant to s 74(2) Unit Titles Act 2010 (“Act”), Body Corporate 366567 (“BC 366567”) applies for an order settling a scheme of repair following destruction or damage (“scheme”). The terms of the scheme are annexed marked Schedule A to the application.
Facts
[2] BC 366567 is the body corporate of a large (378 unit) unit title development situated in Central Auckland.
[3] The respondents to the application are the unit owners, their mortgagees or charge holders, and AIG, which is the insurer of BC 366567. Service on all those the Act requires be served has been effected or dispensed with by order of the Court. The required information has also been lodged with Land Information New Zealand. None of these parties has expressed opposition to the scheme or the making of the order sought.
[4] The significant deficiencies and defects in the development are identified in an affidavit of Mr T Jones, sworn on 11 December 2021. Mr Jones is a chartered and registered building surveyor. In his affidavit, Mr Jones also identifies the scope of the extensive remedial works required.
[5] At an Extraordinary General Meeting (“EGM”) on 22 November 2021, a unanimous resolution was passed that BC 366567 would apply to this Court for an order settling the scheme.
Relevant law
[6] The principles to be applied in determining an application under s 74 are well established in cases such as Tisch v Body Corporate No 318596.1 Although Tisch was decided before the Act came into force, it continues to apply.2

[7] An applicant for approval of a scheme must show that the building has been, or is likely to be, damaged or destroyed; that it is appropriate to settle a scheme of repair; and that the terms of the proposed scheme are appropriate. As to the latter, the following matters should be considered:
(a)A scheme with broad support is to be preferred.
(b)The scheme should be appropriately detailed, so as to minimise the scope for dispute.
(c)The order settling the scheme may be of retrospective effect, provided the body corporate has acted in accordance with the scheme prior to the Court’s approval.
(d)Remedial work is usually to be carried out to the same standard in relation to all units, and at the same time.
(e)The terms of the scheme should not depart from the Act and the rules of the body corporate any more than is reasonably necessary to achieve fairness between unit owners.
Damage or destruction
[8]The building is damaged. Mr Jones’ affidavit lists numerous defects.
Is a scheme appropriate?
[9] The repairs and remedial works comprise a substantial undertaking, to be carried out at great cost, financial and otherwise, and with the assistance of numerous consultants, experts and contractors. It is therefore appropriate for BC 366567 to formulate a scheme and to apply to the Court for an order pursuant to s 74(2).
Terms of the scheme
Broad support
[10] The unanimous resolution of BC 366567 at the EGM, and the lack of opposition, evidences that the proposed scheme has broad support.
Sufficiently detailed
[11] The scheme contains a level of detail and is on similar terms to others this Court has approved, such as those in Body Corporate 355492, and Body Corporate 384825.
Retrospectivity
[12] The scheme has retrospective effect in so far as concerns costs incurred in identifying the defects in the building and/or carrying out repairs, and also in collecting and levying costs. I am satisfied this retrospectivity is appropriate.
Same standard etc
[13] The scheme provides for the required remedial works to be carried out, regardless of whether they are to common property or to unit property. It also requires BC 366567 to ensure that the works are undertaken at the same time and to the same standard. The scheme also requires BC 366567 to obtain a building consent (which appears already to have been issued) and a code compliance certificate for the works.
Terms of the scheme consistent with the Act
[14] The terms of the scheme are in keeping with the scheme of the Act. In particular, I am satisfied they are consistent with ss 121, 126 and 138 of the Act.
Conclusion
[15] BC 366567 has demonstrated a need for a scheme of repair. The scheme is appropriate, fair, and unopposed, and I am satisfied it meets the requirements set out in Tisch.
Result
[16] Accordingly, I make an order that the scheme annexed and marked Schedule A to the originating application dated 15 December 2021 be settled pursuant to s 74 of the Unit Titles Act 2010.
