CaseChat Overview and Summary

In the case of Wright v Milne, the appellant, Erin Edith Patricia Wright, sought a stay of a decision made in the minor civil dispute jurisdiction of the Queensland Magistrates Court. The decision in question awarded money to the respondent, David Milne. The appeal centred on whether the balance of convenience favoured the granting of a stay and whether the appeal would be rendered nugatory if a stay were granted. Wright argued that the balance of convenience favoured a stay, while Milne opposed the stay on the grounds that the appeal would be rendered nugatory if granted.

The court considered the general principles applicable to the grant or refusal of a stay of proceedings. It examined the balance of convenience and the potential for the appeal to be rendered nugatory if the stay were granted. The court found that the balance of convenience did favour granting a stay, given the significant financial implications for Wright if the decision were to be enforced immediately. Additionally, the court concluded that the appeal would not be rendered nugatory if a stay were granted, as the appeal could still be heard and determined on its merits.

Accordingly, the court granted the application for a stay subject to certain conditions. Wright was required to pay the awarded amount into trust within seven days, and the money would be held until the determination of the appeal or application for leave to appeal. Failure to comply with the payment condition would result in the stay being refused without further notice to the parties.

The court also extended the time for David Milne to comply with Direction 7 of the directions dated 11 March 2019 to 4:00pm on 25 March 2019, unless otherwise ordered.
