The court found that Dean Appliances had engaged in conduct in contravention of s 52 and granted injunctive relief, prohibiting Dean Appliances and the Leasks from using the name "Deans Appliances" and requiring them to take steps to terminate their use of certain telephone numbers. The court also allowed Winning Appliances to file further written submissions on the question of damages before finally determining that issue. The court rejected the passing off claim, finding that Winning Appliances had not established that Dean Appliances' conduct involved a representation that its business was that of Winning Appliances.
