Background

1. This is a decision on the opposition under s 52 of the Trade Marks Act 1995 (Cth) (‘Act’)[1] by Volvo Trademark Holding AB (‘Opponent’) to registration of trade mark application number 2160985 for the word VOVO (‘Trade Mark’) filed on 5 March 2021 (‘Relevant Date’) by Vovo Corporation Co Ltd (‘Applicant’) in class 11 for:

electric air cleaner; air purifiers; air purifiers for automobiles; portable air cleaners; toilet bowls; bidets; urinals being sanitary fixtures; tap water faucets; showers; wash-hand basins being parts of sanitary installations; bath tubs; ventilators for household use; gas grills for household use; water purifiers for household purposes; gas ranges; air conditioners for household purposes; ice-cooling refrigerators for household purposes; air filters for air cleaners; electrical lighting fixtures; air sterilizing apparatus (‘Applicant’s Goods’)

[1] Unless otherwise stated, each reference to a regulation below is a reference to a regulation in the Trade Marks Regulations 1995 (Cth) and each reference to a section is a reference to a section of the Trade Marks Act 1995 (Cth).

2.     The Trade Mark was examined and advertised as accepted for possible registration on 6 August 2021.

3.     The Opponent filed a Notice of Intention to Oppose on 1 October 2021, followed by a Statement of Grounds and Particulars (‘SGP’) on 28 October 2021.  A Notice of Intention to Defend the opposition was filed by the Applicant on 7 January 2022.

4.     The Opponent filed Evidence in Support of the opposition on 11 April 2022 consisting of a declaration of Monica Dempe, Managing Director of the Opponent, made on 10 April 2022 with Exhibits MD-1 to MD-28 (‘Dempe Declaration’).  The Applicant then filed its Evidence in Answer on 6 July 2022 comprising a declaration of Seong Yeo Jung, Director of the Applicant, made on 4 July 2022 with Exhibits SYJ-1 and SYJ-2.  The Opponent did not file Evidence in Reply.

5.     Following the evidence stages, the parties were given the opportunity to request a hearing and the Opponent requested a decision without a hearing.  I make this decision as a delegate of the Registrar of Trade Marks based on the information in the SGP and evidence filed by the parties.

Grounds, onus and relevant date

6.     In its SGP, the Opponent nominated grounds of opposition under ss 42(b), 44, 60 and 62A.

7.     The Opponent bears the onus of establishing at least one of the nominated grounds of opposition[2] on the balance of probabilities.[3]

8.     The rights of the parties are to be determined at the Relevant Date.

The Opponent

9.     The Opponent is a holding company that owns various trade marks consisting of or containing the word ‘VOLVO’ worldwide, including the Australian registrations set out in Annexure A (‘Opponent’s Trade Marks’), and licenses those marks to Aktiebolaget Volvo and Volvo Car Corporation for use in their respective businesses.  For the purposes of this decision, I will refer to Aktiebolaget Volvo, Volvo Car Corporation and their respective subsidiaries as the ‘Volvo Group’ and when I refer to the use of a mark owned by the Opponent, I include use by the Volvo Group.  The goods and services for which the Opponent’s Trade Marks are registered are collectively referred to as the (‘Opponent’s Goods and Services’). Each of the marks for the word ‘VOLVO’ by itself are referred to collectively as the ‘VOLVO Mark(s)’.

10.   The Volvo Group is one of the world’s leading designers and manufacturers of cars, car parts, car accessories, trucks, buses, and construction equipment, engines and drive systems for marine and industrial applications and related accessories.

11.   The VOLVO Mark was first used in relation to trucks and buses in Sweden in 1928.  Since 1967, the VOLVO Mark has been used in Australia in relation to trucks assembled here and since 1972, for the manufacture of trucks in Australia.  VOLVO branded trucks are sold and serviced in Australia through a network of authorised dealers and service locations.  These authorised dealers and numerous independent sellers also sell second-hand VOLVO trucks. 

12.   The VOLVO Mark has also been used in Australia for many years in relation to cars, construction equipment, marine and industrial engines, spare parts for these goods, the repair and servicing of many of these vehicles and the provision of financial services.  The Dempe Declaration provides the annual sales figures in Australia for Volvo Trucks, Volvo Buses, Volvo construction equipment and VOLVO PENTA marine and industrial engines which are very substantial. 

13.    The Opponent’s VOLVO branded goods have been extensively advertised at considerable expense in Australia and throughout the world. The VOLVO Mark is used on goods, services, packaging, labelling brochures, specification sheets, engines, parts and signage. The Volvo Group has incurred very significant expenses in marketing its goods and services globally and in Australia under the VOLVO Mark including through print, television, radio, online, social media, billboards, sponsorships, trade fairs and exhibitions, corporate brochures and presentations.    

14.   Ms Dempe attests that the VOLVO Mark for various parts and accessories for vehicles including air purifiers for vehicles which are sold as spare parts in Australia.

15.   The VOLVO Mark has been found to be well known by a number of overseas courts and Trade Mark Offices and found to be famous in various Internet Corporation for Assigned Names and Numbers domain name dispute proceedings.

The Applicant

16.   The Applicant produces and sells a range of bidets, foot and body dryers and air purifiers under the Trade Mark in Korea, USA, Europe, Japan and China but has not yet commenced use of the Trade Mark in Australia.  The Applicant or its local subsidiary has registered the Trade Mark in various countries including the USA, Japan, Europe and China.

Discussion

Section 44

17.   Section 44 relevantly provides:

Identical etc. trade marks

(1) Subject to subsections (3) and (4), an application for the registration of a trade mark (applicant's trade mark) in respect of goods (applicant's goods) must be rejected if:

(a) the applicant’s trade mark is substantially identical with, or deceptively similar to:

(i) a trade mark registered by another person in respect of similar goods or closely related services; or

(ii) a trade mark whose registration in respect of similar goods or closely related services is being sought by another person; and

(b) the priority date for the registration of the applicant's trade mark in respect of the applicant's goods is not earlier than the priority date for the registration of the other trade mark in respect of the similar goods or closely related services.

18.   In its SGP, the Opponent relied on the Opponent’s Marks, full details of which are set out in Annexure A.

  1. Hereinafter, the marks which are the subject of registration numbers 1211455, 1735633 and 1735646 are referred to as the Opponent’s Logo Marks.  The marks VOLVO PENTA and VOLVO SELEKT are collectively referred to as the Opponent’s Composite Marks.

  2. To successfully oppose the Application pursuant to s 44, the Opponent must establish that a trade mark registered or applied for by a person other than the Applicant:

    ·     has a priority date which is earlier than that of the Trade Mark (‘the first requirement’);

    ·     is substantially identical with, or deceptively similar to the Trade Mark (‘the second requirement’); and

    ·     is in respect of goods and/or services which are similar or closely related to the Applicant’s Goods (‘the third requirement’).

    21.   Each of the above marks satisfies the first requirement in that these registrations are in the name of a person other than the Applicant and have an earlier priority date than the Trade Mark.

Substantially Identical or Deceptively Similar

22.   The test for whether two marks are substantially identical requires that they be compared:

side by side, their similarities and differences noted and the importance of these assessed having regard to the essential features of the registered mark and the total impression of resemblance or dissimilarity that emerges from the comparison.[4]

23.   The most relevant marks for comparison in this case are:

24.   In my opinion, VOVO and VOLVO are not substantially identical.  The VOLVO Mark is 5 letters long as compared to 4 letters in the Trade Mark.  Although the marks differ by only a single letter in the middle of the VOLVO Mark, this letter is sufficient to create obvious differences between the two marks.  In my opinion, the Trade Mark is not substantially identical to the VOLVO Mark.  Hence it follows that the Trade Mark is not substantially identical to any of the Opponent’s Marks.

25.   Section 10 provides that a trade mark is taken to be deceptively similar to another trade mark if it so nearly resembles that other trade mark that it is likely to deceive or cause confusion.

26.   The assessment of deceptive similarity was also considered by Windeyer J in Shell who observed:

On the question of deceptive similarity a different comparison must be made from that which is necessary when substantial identity is in question. The marks are not now to be looked at side by side. The issue is not abstract similarity, but deceptive similarity. Therefore the comparison is the familiar one of trade mark law. It is between, on the one hand, the impression based on recollection of the plaintiff's mark that persons of ordinary intelligence and memory would have; and, on the other hand, the impressions that such persons would get from the defendant's [mark].[5]

27.   For trade marks to be considered deceptively similar there must be a real and tangible danger of deception or confusion occurring.  This will be the case where there is a real likelihood that an ordinary person would be caused to wonder whether the goods or services come from the same trade source.  The basis for any deception or confusion is the impression or recollection of the trade marks that is carried away and retained by the ordinary consumer, allowing for an imperfect recollection of the trade marks.  The impression comes from the trade marks as a whole, and involves a consideration of the look, sound and ideas conveyed by the trade marks.   

28.   In Self Care IP Holdings Pty Ltd v Allergan Australia Pty Ltd, the High Court recently explicitly rejected the application of any principle that reputation in a mark may decrease the likelihood of imperfect recollection and held that reputation should not be taken into account when assessing deceptive similarity.[6]  Although this finding was made in relation to an allegation of infringement under s 120(1), it is equally applicable under s 44.

29.   The Trade Mark and VOLVO Mark both commence and end with the letters “VO” creating the same visual symmetry in each of the marks.  Although the additional letter ‘L’ in the VOLVO Mark affects the pronunciation of that mark, the letter ‘L’ does not have a strong sound like other letters such as ‘X’ or ‘K’.  Whilst not identical in sound, the Trade Mark and VOLVO Mark have a degree of aural similarity as a result of the repetition of the “VO” element at the beginning and ending of each of the marks.  Some of the Opponent’s older registrations have an endorsement that VOLVO is a Latin word for “I am rolling” but Latin is a dead language and it is improbable that the average Australian consumer would be aware of this meaning.  Accordingly, it is likely that consumers will consider both of the marks to be invented words.  Therefore, although most of the Applicant’s Goods will be purchased with some care, taking into account the doctrine of imperfect recollection, I am satisfied that the Trade Mark is deceptively similar to the VOLVO Mark.

30.   Turning to a consideration of the Opponent’s Logo Marks, the only textual element of these marks is the word VOLVO which I have already noted is deceptively similar to the Trade Mark.  The device element of each of these marks is not sufficient to dispel any likelihood of confusion and hence, I regard the Opponent’s Logo Marks as being deceptively similar to the Trade Mark.

31.   Having found that the Trade Mark is deceptively similar to the VOLVO Mark and Opponent’s Logo Marks, I turn to a consideration of whether the Opponent’s registrations for these marks cover similar goods or closely related services to the Applicant’s Goods.

Similar Goods / Closely Related Services

32.   The question of whether the VOLVO Mark and Opponent’s Logo Marks cover similar goods or closely related services to the Applicant’s Goods is a question of fact.[7]

33.   The factors to be considered in deciding whether goods are similar include the nature and characteristics of the goods, their origin, their purpose, whether they are usually produced by the same manufacturers, whether they are sold in the same shops and to the same class of consumers.[8]

34.   The Opponent’s Logo Marks cover a range of parts and accessories for vehicles as well as “lighting apparatus and installations (also for vehicles) … installations and apparatus for air filtering and air conditioning, ventilation, cooling or heating … apparatus for steam generating, cooking, drying, water supply or sanitary purposes”.  These broad descriptions encompass the Applicant’s Goods.  Accordingly, the Applicant’s Goods are similar to the goods of the Opponent’s Logo Marks.

35.   Having found that the VOLVO Mark and Opponent’s Logo Marks are deceptively similar to the Trade Mark and cover similar goods, it is not necessary to consider the Opponent’s Composite Marks.

36.   The Applicant had not commenced use of the Trade Mark at the Relevant Date and hence, there is no evidence of honest concurrent or prior continuous use.  Further, the Applicant has not put into evidence any other circumstances that may justify the allowance of the Trade Mark under the provisions of s 44(3)(b).  Accordingly, the s 44 ground of opposition is established. 

Decision

37.   I find that the Opponent has established a ground of opposition under s 44.  Accordingly, I refuse to register trade mark number 2160985.

38.   Costs generally follow the event and hence I award costs against the Applicant in accordance with the amounts set out in Schedule 8 of the Regulations.
