Ukrainian Association of Western Australia in Perth (Inc) v Squire Constructions Pty Ltd

The Ukrainian Association of Western Australia in Perth (Inc) sought leave to appeal from the interim and final awards of the arbitrator, Mr A B Goold, in an arbitration between the parties over the construction of the Ukrainian Community Centre in Bassendean. The court considered seven proposed grounds of appeal. The court found that there was no manifest error of law on the face of the award, nor strong evidence of an error of law, and that the determination of the questions of law, if they existed, would not add substantially to the certainty of commercial law. The court refused the plaintiff leave to appeal the award.
