THE PRESIDENT:  The orders are:

In lieu of Order 5 made in this matter on 29 July 2005, it is ordered that the respondent pay the appellant's costs of and incidental to the trial on an indemnity basis and of the appeal on a standard basis.

It is further ordered that on payment of the amount of $253,760, being $213,760 judgment and $40,000 on account of costs, the caveat be removed.

Liberty to apply to a judge of the Trial Division on two clear days' notice to the other side.
