St Kilda Beach Taxi School and Staffing Pty Ltd commenced proceedings against Central Taxi Management Pty Ltd for the return of a taxi plate and for damages. The plaintiff was entitled to an account of profits from the defendant for the period after the reasonable notice expired and the defendant failed to return the plates. The defendant was liable to pay damages to the plaintiff. The court dismissed the defendant's application to set aside the default judgment, dismissed the defendant's counterclaim for damages, and ordered the defendant to deliver the taxi plate to the plaintiff and pay damages assessed at $18,249. The court also dismissed the plaintiff's counterclaim against the defendant and ordered the plaintiff to pay damages to the defendant assessed at $72,968.
