The applicant, SCVG, sought to file an Application in a Case on 4 December 2017. The respondent was KLD. The matter came before Gill J in the Federal Court of Australia.

The primary legal issue before the Court was whether the applicant should be excused from compliance with the Rules of Court concerning the commencement of proceedings by an Initiating Application, and if so, when the Application in a Case should be taken as filed.

Gill J considered the applicant's request for an order excusing non-compliance with the Rules. The Court determined that it had the power to grant such an excuse. Consequently, the Court ordered that the applicant be excused from compliance with the Rules requiring the Application in a Case to be commenced by an Initiating Application. The Court further ordered that the Application in a Case be taken as filed on 24 January 2018. The proceedings were then adjourned for a hearing on 15 February 2018.
