CaseChat Overview and Summary
Scentre Management Limited, the plaintiff, challenged the decision of the ACT Planning and Land Authority to approve a development application for the redevelopment of a produce market at Belconnen. The plaintiff alleged that the approval decision was flawed for a number of reasons, including that the decision-maker was biased, and that the decision was inconsistent with advice given by relevant entities, and failed to observe the requirements for reasons. Elanor Funds Management Ltd, the third defendant, argued that the plaintiff lacked standing to bring the proceeding and that the approval decision was valid. The plaintiff also argued that the approval decision was flawed in that it failed to observe the requirements for reasons. The court found that the plaintiff lacked standing to bring the proceeding because there was no likelihood that the plaintiff's interest would be adversely affected by the approval decision. The court also found that the approval decision was valid. The approval decision did not fail to observe the requirements for reasons because the decision-maker was required only to set out the reasons for approval, not the reasons against approval. Nor was the approval decision inconsistent with the advice given by relevant entities because the approval was subject to conditions which ensured that the advice was substantially observed. The approval decision was not flawed by any apprehended bias on the part of the decision-maker because the court found that there was no reasonable basis for a fair-minded observer to apprehend that the decision-maker would decide the matter other than on its merits.
