CaseChat Overview and Summary
The primary legal issue was whether the trial judge erred in not adequately considering the mitigating factors presented, namely the respondent's anxiety and the need to support a family member. The respondent's legal team argued that the trial judge did not properly weigh these factors, which could have resulted in a lesser sentence. The prosecution maintained that the sentence was appropriate given the seriousness of the offences.
The court found that while the trial judge did consider the mitigating factors, they did not sufficiently emphasise the impact of these factors on the respondent's culpability and the overall sentence. The court held that the trial judge should have given more weight to the mitigating factors, particularly the respondent's anxiety and the need to support a family member. As a result, the court quashed the sentence and ordered a re-sentencing hearing to ensure that all relevant mitigating factors were properly considered.
