  2. The Respondents, whether by themselves, their servants, agents or otherwise be permanently restrained from causing or authorising any of the sounds recordings contained within the PPCA Catalogue to be performed in public without the licence of the relevant applicants.

  3. Damages be awarded to the Applicants pursuant to s. 115(2) of the Copyright Act 1968 (Cth) in the sum of $39,946.90.

  4. Damages be awarded to the Applicants pursuant to s. 115(4) of the Copyright Act 1968 (Cth) in the sum of $200,000.00.

  5. Damages be awarded to the Applicants for breach of the Settlement Agreement in the sum of $17,175.12.

  6. Interest be awarded to the Applicants pursuant to s.75 of the Federal Magistrates Court Act 1999 (Cth) in the sum of $4,753.76.

  7. The Respondents are to pay the Applicants’ costs and disbursements of, and incidental to, the Application filed on 11 October 2013 and the Application in a Case filed 21 December 2012 fixed in the sum of $8,200.00.

REASONS FOR JUDGMENT

Introduction

  1. Before the Court is an application in a case filed on 21 December 2012 seeking default judgment pursuant to Rule 13.03B of the Federal Magistrates Court Rules 2001 (Cth) (the “FMC Rules”) or in the alternative, summary judgment pursuant to Rule 13.07 of the FMC Rules. The principal proceedings were commenced by an application filed on 11 October 2012 under the Copyright Act 1968 (Cth) (the “Copyright Act”). The proceedings arise from:

    a)The alleged infringement by the respondents of copyright in certain protected sound recordings (“Copyright Infringement Claim”). The rights which are alleged to be infringed are conferred by s. 85(1)(b) of the Copyright Act, namely, to cause sound recordings to be heard in public; and

    b)The alleged breach of an agreement between the first applicant and the respondents (“Breach of Contract Claim”).

    Rule 13.07 of the FMC Rules deals with disposal of a matter by way of summary judgment. Because of the detailed and thorough preparation by the Phonographic Performance Company of Australia on its behalf and that of the other applicants I believe the appropriate approach, having regard to the circumstances and conduct of these proceedings, is to give summary judgment under rule 13.07. There is sufficient evidence before the Court to satisfy me that judgment should be entered against the respondents.

  2. That application seeks relief in respect of the asserted infringement of copyright in sound recordings performed in public. The application seeks declaratory relief, a permanent restraining order, damages pursuant to s. 115(2) of the Copyright Act or, in the alternative at the election of the applicant, an account of profits, damages pursuant to s.115(4) of the Copyright Act, damages for breach of contract in the sum of $17,175.12 and interest pursuant to s. 76 of the Federal Magistrates Court Act 1999 (Cth) and costs.

  3. The principal application by the first applicant, the Phonographic Performance Company of Australia (“PPCA”) and the other 1,124 applicants listed in Attachment “A” (“Record Companies”) (together, the “Applicants”) alleges that the first respondent, Evermore Entertainment Pty Ltd (“Evermore”) and the second respondent, Stephen Cowper Loring Lowe (“Lowe”) (together, the “Respondents”) have infringed the Record Companies’ copyright in certain sound recordings. Evermore has been the operator of the business known as Nevermind, incorporating a nightclub situated at Level 1, 163 Oxford Street, Darlinghurst, NSW (the “Venue”) from at least November 2008. Lowe is the sole officer of Evermore and is also the liquor license holder for the venue. The right that is alleged to have been infringed is conferred s. 85(1)(b) of the Copyright Act, being the right to cause sound recordings to be heard in public.

The organisation listed in the third column above (being one of the licensors) is the owner or exclusive licensee in Australia of the Copyright subsisting in the sound recording listed in the first column.

  1. Copyright subsists in the sounds recordings under the labels identified at and is referred to as the PPCA Catalogue (“PPCA Catalogue”).  The licensors are the owners or exclusive licensees in Australia of the copyright subsisting in all the sound recordings referred to in the PPCA Catalogue.  Evermore and Lowe infringed the copyright subsisting in the identified sound recordings by, without the license of the respective applicant or PPCA, causing or authorising the identified sound recordings to be heard in public.

  2. In addition to the infringements alleged in [4], from at least or from about 1 July 2011 Evermore and Lowe have infringed the copyright subsisting in the sound recordings within the PPCA Catalogue by, without the license of the relevant licensor or PPCA, causing or authorising sound recordings within the PPCA Catalogue to be heard in public.  On or about 18 September 2009, Evermore and Lowe entered into an agreement with PPCA in relation to the settlement of a claim made by PPCA in respect of Copyright infringement of protected sound recordings performed at the Venue on 9 May 2009.  In that agreement, Evermore and Lowe admitted infringement of copyright in identified sound recordings within the PPCA Catalogue.  On the occasions that PPCA officers visited the venue, sound recordings within the PPCA Catalogue were heard in public.  It is claimed that there is no reason to believe that the sound recordings would have been played on only these occasions, and not others.  In the period from 1 July 2011 until the commencement of these proceedings on 11 October 2012, PPCA has written to Evermore and Lowe on numerous occasions.  In that correspondence PPCA has alleged that Evermore and Lowe were playing sound recordings found in the PPCA Catalogue.  Evermore and Lowe have never denied this allegation.

  3. As a result of the infringements referred to in [5] and [6] above, PPCA and the respective Record Companies have suffered loss and damage.  The PPCA and the Record Companies seek damages and orders restraining Evermore and Lowe from causing the sound recordings to be played by Evermore and Lowe in public.  Pursuant to input agreements entered into between PPCA and the Record Companies, PPCA is entitled to commence proceedings in connection with the infringement of the Record Companies’ rights (Affidavit of Anna Killick sworn 20 December 2012).  As the holder of a non-exclusive license, PPCA can sue for breach of copyright if it joins the owners of the copyright as a co-plaintiff: Sega Enterprises Ltd v Galaxy Electronics Pty Ltd (1998) 39 IPR 577 at 581 – 582.

  4. It is for this reason that the PPCA has joined all the Record Companies as applicants.  The PPCA has adopted a similar method in Phonographic Performance Co. of Australia Ltd v Adelaide City Entertainment [2005] FMCA 923; Phonographic Performance Co. of Australia Ltd v All Girls Entertainment Pty Ltd [2010] FMCA 593; Phonographic Performance Co. of Australia v Jabouri Brothers Pty Ltd [2011] FMCA 799; Phonographic Performance Co. of Australia v Camilleri [2012] FMCA 147; Phonographic Performance Co. of Australia v Advanced Beauty and Body Care Pty Ltd & Ors [2012] FMCA 486 and Phonographic Performance Co. of Australia Ltd & Ors v The Martini Lounge & Nightclub Pty Ltd & Ors [2013] FMCA 67.

  5. A genuine steps statement as required by s. 6 of the Civil Dispute Resolution Act 2011 (Cth) was filed on 11 October 2012. It sets out the following steps that have been taken to try to resolve the issues in dispute between the applicants and respondents in these proceedings:

    1. The First Applicant, PPCA, has communicated with the Respondents on behalf of all other Applicants.

    2.  The Respondents are responsible for the nightclub known as Nevermind, located at Level 1, 163 Oxford Street, Darlinghurst New South Wales 2010 (“the Venue”).

    3.  The proceedings arise from the Applicants’ claim that the Respondents (or either of them) have infringed copyright in certain protected sound recordings performed in public at the Venue, without the appropriate licence being in operation and that the Respondents breached the terms of a written agreement with the First Applicant dated on or around 27 August 2009 (“Written Agreement”).

    4.  The First Applicant issued the Respondents with a notice terminating the Written Agreement, which took effect on 30 June 2011.  A Creditor’s Statutory Demand (“Demand”) was also served on the Respondents in respect of outstanding licence fees.

    5.  On or about 9 November 2011, PPCA and the First Respondent signed a further agreement for the purpose of settling PPCA’s claim for unpaid fees pursuant to the Written Agreement and the Demand.  The Respondent failed to satisfy this further agreement.

    6.  On 10 December 2011, PPCA obtained evidence of the unauthorised performance of protected sound recordings at the Venue.  By letter dated 11 January 2012, PPCA’s Legal Department advised the Respondents of the Applicants’ claim.

    7.  Between January 2012 and April 2012 PPCA had numerous without prejudice communications with the Second Respondent in respect of PPCA’s claim and the further agreement referred to in paragraph 5 above.  These discussions did not result in resolve PPCA’s claim.

    8.  On 30 April 2012, a draft of the Application herein was sent to the Respondents.

    9.  On 22 June 2012, PPCA obtained further evidence of the unauthorised performance of protected sound recordings at the Venue.  By letters dated 7 August 2012, PPCA’s Legal Department advised the Respondents that this further evidence would also form part of the Applicants’ claim against them for infringement of copyright.  A draft of Statement of Claim herein was also provided by PPCA’s Legal Department to the Respondents.

    10.  No response was received from the Respondents in relation to the communication referred to in paragraphs 6 to 9 above.

  6. The principal proceedings were listed for a first court date directions hearing on 9 November 2012.  PPCA and the Record Companies were represented by Ms B. Davis and the Respondents by Lowe.  This was the only appearance by or on behalf of the Respondents.  At the subsequent hearings on 10 January 1013 and 8 March 2013 there was no appearance for the Respondents.  Mr Lowe’s attendance at the initial directions enabled him to be well aware of the orders made and their significance.  No response was filed, nor any other material by the Respondents.  The following orders were made:

    1.  The Respondents are to file and serve on the Applicants a response to the application no later than 23 November 2012.

    2.  In default of compliance with order 1, the Applicants may have leave and liberty to apply for default judgment.

    3.  The Applicants may issue Notices to Produce by 30 November 2012, returnable on 14 November 2012.

    4.  If Order 1 is complied with, the following orders shall apply:

    (a)    The Applicants are to file and serve on the Respondents any further affidavit evidence relied upon by 14 December 2012;

    (b)    The Respondents are to file and serve on the Applicants any affidavit evidence relied upon by 18 January 2013;

    (c)     The Applicants are to file and serve on the Respondents any evidence in reply by 25 January 2013; and

    (d)    The matter is to be listed for hearing for two days on dates to be fixed by the Court.

    5. The matter is referred to the District Registrar pursuant to the Federal Magistrates Court Rules for mediation. The mediation occur on or before 18 January 2013.

    6.  The Applicants advise my associate of the outcome of the Court mediation within 7 days of it occurring.

    7.  Costs of today’s directions hearing be reserved.

  7. On 21 December 2012 an Application in a Case was filed by PPCA seeking the orders which are set out at [2] above. In support of that application PPCA filed the Affidavit of Anna Killick sworn 20 December 2012 (the “Killick Affidavit”).

  8. As a result of Order 5 made on 9 November 2012 the NSW Registry of the Federal Magistrates Court advised the parties that the matter was listed for mediation in a conference room on Level 17 of the Law Courts Building, Queens Square, Sydney at 10.15am on Thursday 10 January 2013.  By letter dated 21 December 2012 a solicitor in the employ of PPCA advised the Court’s Registry that Order 1 of the Orders dated 9 November 2012 requiring the Respondents to serve and file a response to the application by 23 November 2012 had not been complied with.  Consequently, pursuant to Order 2 of those orders PPCA was, therefore, applying for default judgment against the Respondents and would be lodging an application in a case so seeking in the Registry on that date. 

  9. In the circumstances PPCA advised it would not be necessary for the parties to attend the mediation listed to occur on 10 January 2012 and, therefore, requested that the Court cancel the mediation.  A copy of that letter was forwarded to the Respondents.  On 7 January 2013 I made orders that the mediation listed for 10 January 2013 be vacated and the matter be listed for directions before the Court at 10.15am on 10 January 2013, with the Court’s Registry to advise the parties accordingly.

  10. At the hearing on 10 January 2013 PPCA was represented by Ms B. Davis, but there was no appearance for, or on behalf of, Evermore or Lowe.  Ms Davis moved on the Application in a Case filed on 21 December 2012 and read the following affidavits in support:

    a)Affidavit of Rosanna Zumbo sworn 5 October 2012 (the “Zumbo Affidavit”);

    b)Affidavit of John Sainsbury sworn 26 October 2012 (the “Sainsbury Affidavit”);

    c)Affidavit of Service of Adam Maguire sworn 29 October 2012;

    d)Affidavit of Service of Michael Rumore sworn 19 October 2012;

    e)Affidavit of Anna Killick sworn 20 December 2012;

    f)Affidavit of Service of Thomas Ross sworn 9 January 2013; and

    g)Affidavit of Service of Thomas Ross sworn 9 January 2013.

  11. In the circumstances, based on the very substantial and detailed affidavits filed and read in these proceedings and in the absence of any response or appearance for or on behalf of Evermore or Lowe I was satisfied that the damages in respect of the copyright infringement and the breach of contract claims were made out. 

  12. In the Killick Affidavit Ms Killick who is employed as corporate counsel for PPCA states that one of her responsibilities within PPCA is the management of its National Enforcement Programme (“Programme”).  The Programme aims to protect the interests of the Record Companies who license their public performance rights to PPCA (“Licensors”) as well as Australian recording artists, by obtaining evidence of the unauthorised performance of protected sound recordings in public places and taking legal action based on this evidence.  PPCA arranges for anonymous inspection of businesses that it believes require a licence for the public performance of protected sound recordings, but which do not appear to have obtained one.  These proceedings arise from the unauthorised public performance of protected sound recordings at the Venue.  PPCA obtained its evidence of the unauthorised public performance of sound recordings at the Venue through the Programme.

  13. The Killick Affidavit at [7] states that these proceedings are the direct results of the Respondents’ failure to obtain a public performance licence in respect of protected sound recordings from 1 July 2011.  However, this failure forms part of a history of dealings between PPCA and the Respondents.  This issue also includes incidences of infringement of copyright in protected sound recordings other than those to which these proceedings relate, being periods during which the Venue was licensed by PPCA, where the Respondents breached the terms of the PPCA Licence by failing to pay fees due there-under, resulting in termination of that Licence by PPCA.

  14. I adopt from the Killick Affidavit paragraphs [8] – [19], with minor amendments that effectively set out the procedural steps that took place between the date of filing of the principal proceedings until the trigger event of the filing of the Application in a Case on 21 December 2012:

    8.  The Application and Statement of Claim … were lodged on 11 October 2012.

    9.  The Affidavit, Statement of Claim and Affidavit of Rosanna Zumbo with exhibit were served personally on the Respondents (together with the Applicants’ Genuine Steps Statement) on 19 and 26 October 2012.

    10.    The Affidavit of Service of Michael Rumore, dated 19 October 2012, which related to the service of the documents referred to in the previous paragraph on the First Respondent, was filed by the Applicants on 8 November 2012.

    11.    The Affidavit is Service of Adam Maguire, dated 29 October 2012, which related to the service of the documents referred to in paragraph 9 on the Second Respondent, was also filed by the Applicants on 8 November 2012.

    12.    The Affidavit of John Sainsbury dated 26 October 2012 was filed by the Applicants on 30 October 2012.  It was served on the Respondents under cover of a letter dated 5 November 2012, sent by email and post.  A copy of this letter and covering email is at page 1 and 2 of “AK1”.

    13.    The first hearing of this matter was listed for 9 November 2012 at 9:30am before [the Court]. (Ms B Davis appeared for PPCA).  The Second Respondent appeared on his own behalf.

    14.    A copy of the Order made by [the Court] on 9 November 2012 [appearing at [10] above].  In particular, paragraph 1 of the 9 November Order obliges the Respondents to file and serve a Response to the Application no later than 23 November 2012.  Paragraph 2 of the 9 November Order entitles the Applicants to make an application for default judgment in the event that the Respondents do not comply with the Order at paragraph 1.

    15.    On 13 November 2012, PPCA wrote to the Respondents, by post, providing an unsealed copy of the 9 November Order. … They were sent to the registered office address for the First Respondent and the home address of the Second Respondent.

    16.    On 21 November 2012, PPCA wrote to the Respondents providing a sealed copy of the 9 November Order. … The letter reminded the Respondents of the deadline to file and serve a Response to the Application as set out in the 9 November Order and of the Applicants’ ability to apply for judgment in default in the absence of that Response.

    17.    No Response to the Application was received from the Respondents on 23 November 2012.

    18.    On 26 November 2012, PPCA wrote to the Respondents confirming that it had not received any Response to the Application. … The letters gave the Respondents until 30 November 2012 to file their Response, failing which this Application, for judgment in default, would be made.

    19.    [At the time of the preparing, swearing and filing of the Killick Affidavit] the Respondents have not responses to the letters referred to in the previous paragraph.  Moreover, the Respondents have failed to comply with Order 1 of the 9 November Order.

  1. As noted elsewhere in this judgment, there is a substantial body of affidavit evidence clearly articulating the relationship between the parties to these proceedings.  This evidence indicates that Evermore commenced operation at the Venue in sometime during 2008 and was referred to PPCA at sometime in April 2009 because its operators had failed to obtain a licence for the public performance of protected sound recordings, despite PPCA’s licensing department having written to Evermore on several occasions to notify the operators they required a licence for the public performance of protected sound recordings. 

  2. Evidence of infringement of copyright in protected sound recordings was initially obtained on 9 May 2009.  Correspondence from PPCA to the Respondents dated 29 May 2009 resulted in the Respondents submitting an application for a licence for the Venue.  The Respondents also entered into a confidential settlement agreement with PPCA for payment of fees for the period of the Venue’s operation.  The Venue remained licensed by PPCA under the Licence Agreement until 30 June 2011.  In mid-June 2011 the Venue was referred back to PPCA’s Department of Business and Legal Affairs because Evermore failed to pay PPCA’s licence fees pursuant to the Licence Agreement.  Evermore was given till 30 June 2011 to pay the outstanding licence fees which at that time amounted to $15,059.97, failing which the Licence Agreement would terminate.  Various correspondence is attached to the Killick Affidavit detailing the breach of agreement, the terms of settlement and any further public performances of protected sound recordings.

  3. On or about 31 August 2011 a creditor’s statutory demand dated 22 August 2011 was served on Evermore on behalf of PPCA in respect of the unpaid licence fees due pursuant to the Licence Agreement.  The statutory demand claimed the sum of $14,976.12.

  4. On 9 November 2011 PPCA signed a further confidential settlement agreement with the Respondents, pursuant to which the Respondents were to, among other things, pay the licence fees due to PPCA and claimed in the statutory demand, together with costs.  The Respondents did not comply with the terms of the agreement and no payments were made to PPCA, nor did the Respondents apply to PPCA for a new licence in respect of the public performance of protected sound recordings at the Venue from 1 July 2011.  On or around 13 November 2011, it came to PPCA’s attention that a strike-off action was underway in relation to the Evermore’s registration as a company.  Consequently, PPCA was not able to rely on their statutory demand.  Evermore was deregistered from 8 January 2012.

  5. The Killick Affidavit then provides a comprehensive summary of the events that led to the present claim of copyright infringement.  As a consequence of the failure by the Respondents to comply with the terms of the settlement agreement and the de-registration of Evermore, an inspection of the venue was undertaken to establish if it continued to operate and if it was using PPCA Catalogue material.  An inspection was initially carried out on 10 December 2011 by Rosanna Zumbo which revealed that the Venue continued to operate and on the inspection day used seven titles from the PPCA Catalogue.  Correspondence in respect of this breach was forwarded to Lowe at his personal address. 

  6. During January 2012 Lowe advised PPCA by email that he was in the process of selling the venue as well as reinstating Evermore to the Register of Companies.  During February 2012 PPCA and Lowe communicated, on a without prejudice basis, with a view to settling PPCA’s claim without recourse to legal proceedings, but these discussions did not result in a settlement, nor were any sums paid in respect of the previously unpaid licence fees.  A company search dated 8 February 2012 revealed that Evermore was again registered by ASIC by that date.  During the months of March and April 2012 various correspondence between the parties revealed that there was no settlement date for the proposed sale of the Venue.

  7. On 30 April 2012 PPCA wrote to the Respondents confirming that proceedings would be lodged against them in the near future and provided them with a copy of the draft application.  PPCA resolved to conduct another inspection of the venue prior to commencing these proceedings.  That inspection was conducted on 22 June 2012 by John Sainsbury and that inspection identified three protected sound recordings being played in public at the Venue.  The Zumbo Affidavit and Sainsbury Affidavit provide details of their respective inspections of the Venue and are, effectively, referred to and summarised in the Killick Affidavit.

  8. The claims made by the Applicants are brought under s. 115 of the Copyright Act. The first issue the Court must be satisfied of is that the Applicants have copyright. Under s. 126 of the Copyright Act there are two presumptions in relation to the existence of copyright:

    In an action being brought by virtue of this part:

    (a)    Copyright shall be presumed to subsist in the work or other subject matter to which the action relates.  If the defendant does not put in issue the question whether the copyright subsists in the work or other subject matter; and

    (b)    Where the subsistence of copyright is established – the plaintiff shall be presumed to be the owner of the copyright if he or she claims to be the owner of the copyright and the defendant does not put in issue the question of his or her ownership.

  9. In these proceedings the Respondents have failed to file a response as ordered at the first court date directions hearing on 9 November 2012.  On that date Lowe appeared representing himself but there was no formal appearance for or on behalf of Evermore.  The order requiring the Respondents to file a response by 23 November 2012 was made in Lowe’s presence.  Subsequent to that directions hearing on 13 November 2012 PPCA wrote to the Respondents by post providing an unsealed copy of the 9 November 2012 Orders.  That correspondence was sent to the registered office address of Evermore and the home address of Lowe. 

  10. On 21 November 2012 PPCA again wrote to the Respondents providing a sealed copy of the 9 November 2012 Orders.  In the 21 November 2012 Letter a reminder was provided to the Respondents of the deadline to file and serve a response to the application as set out in the 9 November 2012 Orders and of the Applicants’ ability to apply for a judgment in default, in the absence of that response (Killick Affidavit at [14] – [16]).  When the matter was called back for directions on 10 January 2013 and again on 8 March 2013 there was no appearance for or on behalf of the Respondents.  Consequently, the question of whether copyright subsists in the work and the Applicants’ claim to be the owner of the copyright has not been put in issue. 

  11. I am satisfied that I am entitled to apply these presumptions that copyright subsists in each of the recordings referred to as having been played in the Zumbo Affidavit and Sainsbury Affidavit, and that PPCA and the other Applicants listed in Attachment “A” who are the copyright owners of those recordings are entitled to bring these proceedings.  As there has been no suggestion by Evermore or Lowe that recorded music has not been played at the Venue, Nevermind, since termination of the August 2009 Written Agreement (see [9.3] above) effective on 30 June 2011 or that such recorded music is music that is not part of the PPCA Catalogue I am also satisfied that I may infer that the Respondents have been infringing copyright since that date.

  12. In respect of the copyright infringement claim I determined that Evermore and Lowe were liable to pay the sum of $39,946.90, pursuant to s. 115(2) of the Copyright Act (Statement of Claim at [21(b)]). In respect of the breach of contract claim, I determined that Evermore and Lowe were liable to pay the sum of $17,175.12 for breach of the Agreement (Statement of Claim at [21(d)]). However, in respect of the copyright infringement claim I did not make orders for additional damages pursuant to s.115(4) of the Copyright Act, nor did I make an order for the payment of interest on the sums awarded or the costs of the application. In regard to these issues I required the Applicants to make written submissions addressing these issues to assist in the preparation of written reasons and orders in relation to these outstanding issues.

  13. Section 115(4) of the Copyright Act permits the Court to award additional damages where an infringement of copyright has been established and where the Court considers it proper to do so. The principles are well established and the purpose is to penalise an infringer of copyright. Additional damages are an independent head of relief, beyond the objective of compensation for the copyright owner: Raben Footwear Pty Ltd v Polygram Records Inc & Anor (1997) 145 ALR 1 at 6. The relevant factors in this matter which the court may take into account include flagrancy of infringement (s. 115(4)(b)(i)), need to deter similar infringements (s.115(4)(b)(ia)), the conduct of the defendant after the act constituting the infringement or, if relevant, after the defendant was informed that the defendant had allegedly infringed the plaintiff’s copyright (s.115(4)(b)(ib)), any benefit shown to have accrued to the defendant by the reason of the infringement (s.115(4)(b)(iii)), or other relevant matters (s.115(4)(b)(iv)).

  14. In respect of the issue of flagrancy of the infringement, pursuant to the affidavit material before the Court there can be no doubt that the respondents have deliberately the Record Companies’ copyright.  PPCA took the following steps to notify the Respondents of the nature of the infringements:

    a)On 17 June 2011, PPCA provided the Respondents with a notice of termination of Evermore’s licence which was due to expire on 30 June 2011, along with the consequences of that termination (Killick Affidavit, Annexure “AK1” pp.37 – 38).  No response was received; and

    b)Since 1 July 2011 the Respondents have been given several separate communications notifying them that they were obliged to enter into a new licence agreement and pay licence fees following the termination of the previous Licence Agreement.  The Respondents failed to obtain a licence or pay licence fees and continued to publicly play the Record Companies’ recorded material without a licence.  These communications included:

    i)On 5 July 2011 the Respondents were advised that Evermore’s licence had terminated on 30 June 2011 and that any public performance of the protected sound recordings at the Venue would amount to an infringement of copyright.  This letter was sent to the Venue’s trading address, Lowe’s personal address and Evermore’s registered office address (Killick Affidavit at [33]);

    ii)On 23 November 2011 the Respondents were advised by letter, again summarising the position in relation to any public performance of protected sound recordings at the Venue.  This letter was sent to the Venue’s trading address, Lowe’s personal address and to Evermore’s registered office address (Killick Affidavit at [38]);

    iii)On 11 January 2012 a letter to the Respondents advised them that an inspection of the Venue had been conducted and that seven protected sound recordings had been heard at the Venue on 10 December 2011 (Killick Affidavit at [41]).  This inspection was conducted by Rosanna Zumbo (Zumbo Affidavit).  The letter was sent to the Venue’s trading address, Lowe’s personal address and Lowe via email message (Killick Affidavit at [41]);

    iv)On 25 January 2012 Lowe advised PPCA by email that he was in the process of selling the Venue.  On the same day by email PPCA requested information of the date upon which the Venue was to be sold.  Lowe responded that there was no set date and that he would keep PPCA informed as to any settlement date (Killick Affidavit at [42] – [44]);

    v)On 8 March 2012 further email exchanges took place between the parties, in which PPCA again sought confirmation of the settlement date for the Venue’s sale and Lowe stated he did not have one (Killick Affidavit at [49]);

    vi)On 10 April 2012 PPCA wrote to Lowe requesting he provide an update in relation to the position of the Venue (Killick Affidavit at [50]);

    vii)On 30 April 2012 PPCA wrote to Lowe advising that proceedings would be lodged in the near future and provided a draft application.  Copies of the letter were sent to the Venue’s trading address, Evermore’s registered address and Lowe’s personal address (Killick Affidavit at [50]); and

    viii)On 7 August 2012 the Respondents were advised of the results of a second inspection of the Venue carried out by John Sainsbury on 22 June 2012 (Sainsbury Affidavit, Killick Affidavit at [51]) and enclosed a copy of the draft statement of claim (Killick Affidavit at [52] – [53]).

  15. The Zumbo Affidavit and Sainsbury Affidavit detail the infringements that occurred during the inspections of the Venue on 10 December 2011 and 22 June 2012.  The submissions prepared by Ms Killick indicate that in addition to that sworn evidence on two specific dates, at other times the Respondents have infringed the Record Companies’ copyright by causing or authorising the Record Companies’ sound recordings to be heard in public at the Venue without a licence since 1 July 2011 and that activity is continuing.  The material provided to support that inference is as follows:

    a)The playing of recorded music is inherent in nightclubs such as the Venue;

    b)Evermore held a PPCA licence for the public performance of protected sound recordings at the Venue for the period 1 November 2010 to 30 June 2011, supporting the view that such a business would use recorded music in its operation as a matter of course (Killick Affidavit, Annexure “AK1” pp. 58 – 59);

    c)PPCA contacted the Respondents on several separate occasions, upon and after the termination of the previous licence concerning the failure to obtain a licence.  Over that period, the Respondents did not deny that they were publicly playing the Record Companies’ sound recordings at the Venue (Killick Affidavit at [41] – [53]);

    d)The Respondents have not adduced any evidence denying that recorded music was played at the Venue; and

    e)The Respondents have not denied playing the Record Companies’ sound recordings in the past.

  16. Based on the affidavit material before the Court and the absence of any response or appearance by the Respondents I am satisfied that the Respondents have been infringing the Record Companies’ copyright by causing or authorising the Record Companies’ sound recordings to be heard in public without a licence since 1 July 2011 and that such infringements continue.

  17. In respect of the need to deter similar infringements Ms Killick in her written submissions to the Court states that the public performance of protected sound recordings without a licence has become an endemic problem in the recording industry as the very large number of commercial ventures in Australia playing protected sound recordings makes it difficult for PPCA and copyright owners to identify, investigate and prosecute infringers, whereas it is very easy for infringers to play sound recordings and evade detection due to the limited resources of PPCA.  The Respondents are leading examples of infringers as a result of the nature of their business, their behaviour and their calculated decision to continue infringing.

  18. The correspondence attached to the Killick Affidavit shows that the Respondents have made a deliberate decision to disregard PPCA’s demands and these proceedings.  The Respondents have:

    a)Failed to pay the relevant licence fees which subsequently resulted in the Venue’s PPCA licence being terminated;

    b)Not complied with an agreement entered into to satisfy the outstanding licence fees;

    c)Refused to obtain a licence while continuing to trade, despite the many demands made by PPCA over the period of 12 months; and

    d)Failed to comply with orders made by the Court in these proceedings.

  19. The Respondents left PPCA with no choice except to commence court proceedings against them.  In relation to the act of continuing the infringement after being informed, on the information before the Court, the following has occurred:

    a)On 5 July 2011 PPCA wrote to the Respondents informing them that they would infringe the Record Companies’ copyright if a licence was not obtained;

    b)In the period since 5 July 2011 PPCA has contacted the Respondents on several separate occasions, however, the respondents have never denied that they have been infringing the Applicant’s copyright.  The Respondents have sought to delay and obfuscate the Applicants by ignoring PPCA’s correspondence and at other occasions promising to deal with the matter in the near future;

    c)From 1 July 2012 up until the date of the written submissions prepared by Ms Killick, the Venue continued to operate and publicly play the Record Companies’ sound recordings without a licence; and

    d)The Respondents have not paid any part of the licence fees owing to PPCA.

  20. Any benefit accruing to the Respondents by reason of the infringement is significant.  The public performance of sound recordings is not a minor or incidental part of the Venue’s business.  As a nightclub, the Venue generates its business by playing the Record Companies’ sound recordings.  By refusing to pay licence fees the Venue has lowered its costs of doing business and gained a competitive advantage over its competitors who do abide by the law.  The result is that law abiding companies are unfairly disadvantaged by the Respondents’ conduct.

  21. In respect of other relevant matters the written submissions prepared by Ms Killick seek to draw the Court’s attention to the following issues:

    a)If no order for additional damages is made against the Respondents other than legal costs the Respondents will have suffered no real penalty for deliberately refusing to pay licence fees to the Applicants for a protracted period;

    b)The Respondents have expressed no contrition for refusing to pay licence fees and for putting the Applicants to the time and expense of bringing these proceedings.  It is highly likely that the Respondents are continuing to infringe the Record Companies’ copyright;

    c)The Respondents have not filed or served any documents in these proceedings; and

    d)The Respondents have made no promise to cease playing the Record Companies’ recorded music and have not paid any past licence fees.

  22. This is not the first time the Respondents have operated the Venue without paying licence fees to the Applicants.  The Respondents failed to obtain a PPCA licence when they commenced trading at the Venue in late 2008, and only applied for such licence upon PPCA placing the Venue into its National Enforcement Programme and making a legal complaint of copyright infringement against the Respondents as a result of the evidence gathered by its National Enforcement Programme (Killick Affidavit at [22] – [28]).

  23. In determining the appropriate additional damages under s.115(4) of the Copyright Act Ms Killick, in her written submissions, draws the Court’s attention to the following:

    a)The Respondents’ conduct is not an isolated event:

    b)The Respondents have received a very substantial pecuniary benefit from the public performance of the Record Companies’ sound recording by avoiding paying licence fees of approximately $50,000;

    c)The Respondents operate a high profile nightclub and use sound recordings in it in an extremely prominent manner, conduct which is likely to influence others in the industry, justifying a particularly strong need for a deterrent; and

    d)The Respondents have refused to express any contrition at all and the Venue continues its infringing conduct.  The Respondents have made no promise to cease playing the Record Companies’ recorded music or start paying licence fees in the future.  Given that the Venue continues to operate it is highly likely that the infringement of the Record Companies’ copyright is continuing.

    Consequently, the Applicants contend that the award of additional damages should be at the higher end of the scale compared against other cases awarding damages when the infringement of copyright has been established.

  1. In Ms Killick’s written submissions at [40] – [50] she identifies a number of decisions in which additional damages have been awarded.  These cases give a range of damages.  Phonographic Performance Co. of Australia Ltd v Adelaide City Entertainment [2005] FMCA 923 and Phonographic Performance Co. of Australia Ltd v All Girls Entertainment Pty Ltd [2010] FMCA 593 concern cases where the public performance of sound recordings occurred in a nightclub, similar to the situation in the matter currently before this Court. The decisions in Phonographic Performance Co. of Australia v Jabouri Brothers Pty Ltd [2011] FMCA 799, Phonographic Performance Co. of Australia v Camilleri [2012] FMCA 147 and Phonographic Performance Co. of Australia v Advanced Beauty and Body Care Pty Ltd & Ors [2012] FMCA 486 concern the playing of sound recordings in a clothing store, by jukebox in a hotel and in a beauty salon, respectively. In the case of Adelaide City Entertainment (supra), the respondent did not pay any licence fees prior to the hearing and did not attend the hearing.  The sum of $85,000 by way of additional damages was awarded, noting the amount was restricted because the Respondents may not have entirely realised the seriousness of their conduct and its repercussions. 

  2. That qualification does not apply in the proceedings before this Court as the Respondents have been dealing with this issue of breach over a considerable period, resulting in two different settlement arrangements which were subsequently breached and as the public performance of sound recordings continued after these proceedings were commenced.  In the case of All Girls Entertainment (supra) one of the directors attended the hearing, but did not file any evidence or pay any outstanding licence fees. In the other three identified cases (noted at [42] above) the music was being used in a manner that was secondary to the primary endeavours of the organisation, whereas in the matter before this Court the Respondents have received a substantial pecuniary benefit from the public performance of the Record Companies’ sound recordings while avoiding the payment of approximately $50,000 in licence fees.

  3. In the circumstances, I award PPCA on behalf of all of its licensors the sum of $200,000, by way of additional damages under subsection 115(4) of the Copyright Act and this should act as a warning to other current and potential infringers.

  4. I am satisfied on the material before the Court that the copyright infringement by the Respondents is most likely to continue as there has been no evidence, submissions, or appearance (other than at the first court date by Lowe) by or on behalf of the Respondents to indicate to the Court they intend to pay the outstanding fees plus pursue a new licence, or cease playing the Record Companies’ recorded music.  Given that the Venue continues to operate it is highly likely that the infringement of the Record Companies’ copyright will continue. 

  5. In these circumstances a final injunction is warranted in broad terms to prevent further flagrant breach of the Applicants’ copyright.  PPCA seeks interest, pursuant to s.76 of the Federal Magistrates Court Act 1999 (Cth) on the damages awarded against Evermore and Lowe for the breach of contract and pursuant to s.115(2) of the Copyright Act. The Applicants have calculated interest due on the sums awarded on 10 January 2013 at $4,753.76. PPCA also seeks an order for its costs and disbursements, fixed in the sum of $8,200 which has been the amount awarded in similar cases.
