JUDGMENT

THOMAS JA:  The Court consisted of Mr Justice McPherson and Justices Williams and Jones.  The order of the Court is appeal dismissed.  I publish the reasons for judgment of each member of the Court.

I note that in paragraph 17 of Mr Justice McPherson’s reasons, with which the other members agreed, that his Honour indicates that the parties should be allowed 10 days from delivery o the judgment within which to make written submissions on the costs of the appeal.  So perhaps I should also give such a direction.

I direct in those terms that the parties be allowed 10 days from today within which to make written submissions on the costs of the appeal.
