PAUL JOSEPH URE IN HIS CAPACITY AS THE EXECUTOR OF THE ESTATE OF THE LATE DOREEN MARGARET URE
v
THE COMMONWEALTH OF AUSTRALIA & ANOR
[2016] HCASL 88
S52/2016
This is an application for special leave to appeal from the decision of the Full Court of the Federal Court of Australia (Perram, Robertson and Moshinsky JJ), dismissing an appeal from answers to a special case given by Yates J.
The application for special leave to appeal does not raise a question of general importance and the applicant's proposed grounds of appeal do not enjoy sufficient prospects of success to warrant the grant of special leave to appeal. Pursuant to r 41.11.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.

CaseChat Overview and Summary
The legal issues before the court centred on the interpretation of specific statutory provisions and whether the Full Court had correctly applied these provisions in its determination. The applicant argued that the Full Court had erred in its interpretation and application of the law, which led to an unjust outcome. The court was required to assess whether the Full Court's decision was legally sound and whether it warranted the grant of special leave to appeal.
The court found that the application for special leave to appeal did not raise a question of general importance, and the proposed grounds of appeal did not possess sufficient prospects of success. Consequently, the court concluded that the application should be dismissed. The Full Court's decision was affirmed, and the applicant's proposed grounds of appeal were deemed insufficient to warrant special leave to appeal. The court ordered that the application be dismissed with costs, as per rule 41.11.1 of the High Court Rules 2004 (Cth).
