Application for approval of the MSS Security QLD Enterprise Agreement 2014 - 2018.

[1] An application has been made for approval of an enterprise agreement known as the MSS Security QLD Enterprise Agreement 2014-2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by MSS Security Pty Ltd (MSS). The agreement is a single-enterprise agreement

[2] The Agreement was previously approved by the Commission in [2015] FWCA 1559 but on appeal to the full bench in matter C2015/3752, the previous approval decision was set aside on the basis that MSS would provide new undertakings that were approved by the full bench in [2015] FWCFB 6923.

[3] I have accepted the undertaking attached to this decision which has been given by the employer.

[4] I am satisfied that each of the requirements of ss.186, 187, 188 and s.190 as are relevant to this application for approval have been met.

[5] United Voice, being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2), I note that the Agreement covers the organisation.

[6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 8 December 2015. The nominal expiry date of the Agreement is 31 October 2018.
