GORDON J:   In this application Justice Edelman and I order that compliance with the time limit provided for in rule 41.02.1 be dispensed with and special leave to appeal is granted on the condition as proposed by the applicant that the costs orders made by the Full Court of the Federal Court of Australia are not disturbed and that the applicant pay the reasonable costs of the respondent in this Court.  The parties will be contacted about estimates of time for the hearing of the matter and the parties will also be made aware of the directions necessary for undertaking that appeal.

The Court will adjourn to reconstitute.
