1. This application for special leave to appeal requires an extension of time in order to proceed. The appeal foreshadowed by this application for special leave to appeal would not raise any issue of general principle; the appeal would turn on the application of settled principle to the particular circumstances of the case. That being so, special leave should be refused. That being so, it would be futile to grant an extension of time.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
