1. The applicant seeks special leave to appeal from the judgment of the Court of Appeal of the Supreme Court of New South Wales (Mitchelmore and McHugh JJA), dismissing the applicant's application for leave to appeal from a decision of the Supreme Court of New South Wales (Kunc J) making orders striking out the applicant's defence to the respondent's cross-claim without granting leave to replead.

2. There is no reason to doubt the correctness of the decision of the Court of Appeal.

3. Special leave to appeal is refused.
