Kowalski v Attorney-General for the State of South Australia

Case

KOWALSKI

v
ATTORNEY-GENERAL FOR THE STATE OF SOUTH AUSTRALIA

[2020] HCASL 178
A16/2020

  1. The applicant requires an extension of time in which to seek special leave to appeal from the order of Blue J of the Supreme Court of South Australia refusing the applicant's oral application for permission under s 39 of the Supreme Court Act 1935 (SA) to continue to prosecute eight Workers Compensation Tribunal proceedings that were dismissed or struck out by the Full Bench of the Workers Compensation Tribunal in 2002.

  1. An extension of time would be pointless. There is no reason to doubt the correctness of Blue J's decision. The proceedings in the Workers Compensation Tribunal were incapable of being continued. An appeal to this Court would enjoy no prospect of success.

  1. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
