1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Beach JA, J Forrest and Tsalamandris AJJA) allowing an appeal from a decision of the County Court of Victoria (Judge Davis). The proposed appeal would not enjoy sufficient prospects of success and does not raise any question of law of sufficient general importance to warrant a grant of special leave to appeal.

2. Special leave to appeal is refused with costs.
