1. Las Partes

La Demandante es Ints It Is Not The Same, GmbH, con domicilio en Zug, Suiza, representada por UBILIBET, España.

El Demandado es Carlos Gil Belmonte, con domicilio en Murcia, España, representado mediante apoderado, España.

2. El Nombre de Dominio y el Registrador

La Demanda tiene como objeto el nombre de dominio <desigualcorner.es>.

El registrador del citado nombre de dominio es ESNIC.

3. Iter Procedimental

La Demanda se presentó ante el Centro de Arbitraje y Mediación de la OMPI (el “Centro”) el 19 de marzo de 2010. El 19 de marzo de 2010 el Centro envió a ESNIC vía correo electrónico una solicitud de verificación registral en relación con el nombre de dominio en disputa. El 22 de marzo de 2010 ESNIC envió al Centro, vía correo electrónico, su respuesta confirmando que el Demandado es la persona que figura como registrante, proporcionando a su vez los datos de contacto del contacto administrativo, técnico y de facturación. El Centro verificó que la Demanda cumplía los requisitos formales del Reglamento del procedimiento de resolución extrajudicial de conflictos para nombres de dominio bajo el código de país correspondiente a España (“.ES”) (el Reglamento).

De conformidad con los artículos 7a) y 15a) del Reglamento, el Centro notificó formalmente la Demanda al Demandado, dando comienzo al procedimiento el 24 de marzo de 2010. De conformidad con el artículo 16a) del Reglamento, el plazo para contestar la Demanda se fijó para el 13 de abril de 2010. No obstante y, en atención a una confusión producida por la existencia de otro procedimiento de resolución de conflictos entre las mismas partes, el Centro acordó extender el plazo de contestación hasta el día 10 de mayo de 2010. El Escrito de Contestación a la Demanda fue presentado ante el Centro el 7 de mayo de 2010.

El Centro nombró a Manuel Moreno-Torres como Experto el día 21 de abril de 2010, recibiendo la Declaración de Aceptación y de Imparcialidad e Independencia, en conformidad con artículo 5 del Reglamento. El Experto considera que su nombramiento se ajusta a las normas del procedimiento.

4. Antecedentes de Hecho

El Demandante que tiene por objeto social la producción y distribución de ropa, calzado y accesorios, es propietario de las siguientes marcas en las que aparece sola o acompañada el término “desigual”:

Grounds of appeal

[14] The appellant contends that the primary judge erred in finding that the respondent had discharged the onus of establishing the matters required under the relevant provision.

[15] It was submitted that his Honour failed to give adequate weight to the evidence of the second witness, and that the findings of fact were not reasonably open on the material before the Court.

[16] The respondent, for its part, submits that no error is disclosed, and that the conclusions reached were well within the range of outcomes available to the primary judge.

Consideration

[17] It is convenient to deal first with the question of construction, as the resolution of that issue informs the remaining grounds advanced by the appellant.

[18] For the reasons that follow, we are of the view that the appeal should be allowed in part and the matter remitted for further determination.
