1. An extension of time is necessary to enable this application for leave to appeal to proceed. The appeal for which leave is sought by this application has no prospect of success. The decision of Gordon J is clearly correct. The application for leave to appeal should be refused. That being so, it would be futile to grant an extension of time to allow the application to proceed.

2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
