CaseChat Overview and Summary

The parties involved in this case were the applicants and GZK, the attorney under two enduring powers of attorney made by HKE, who had passed away during the hearing. The applicants sought a review of the making, operation, and effect of the enduring powers of attorney under section 36 of the Powers of Attorney Act 2003. The dispute was heard by the Tribunal, which was tasked with determining whether it should exercise its discretion to review the enduring powers of attorney and make orders under section 36(4)(e) of the Act.

The primary legal issue before the Tribunal was whether it should exercise its discretion to conduct a review of the making and operation and effect of the enduring powers of attorney. The applicants argued that the Tribunal should review the powers of attorney, while GZK, as the attorney, opposed the review. The Tribunal had to consider the utility of conducting a review in light of HKE’s death and the absence of any relevant matters that would benefit from such a review.

In reaching its decision, the Tribunal considered the provisions of the Powers of Attorney Act and the circumstances of the case. It found that there was no utility in conducting a review of the making and operation and effect of the enduring powers of attorney, as HKE had passed away and there were no relevant matters that would be served by a review. Consequently, the Tribunal exercised its discretion not to conduct a review and dismissed the application. The Tribunal made a declaration that it would not carry out a review of the making and operation and effect of the enduring powers of attorney.
