HERBERT

v

NEW SOUTH WALES LAND AND HOUSING CORPORATION & ANOR

[2020] HCASL 186
S89/2020

  1. The applicant seeks an order that compliance with r 41.02.1 of the High Court Rules 2004 (Cth) be dispensed with to allow him to file an application for special leave to appeal from the whole of a judgment of the Court of Appeal of the Supreme Court of New South Wales (Macfarlan and Meagher JJA) dated 30 April 2020, refusing leave to appeal from orders of the Supreme Court (Adamson J).

  2. The application does not raise any doubt as to the correctness of the decision of the Court of Appeal. Accordingly, it would be futile to grant an extension of time within which to file an application for special leave.

  3. Pursuant to r 41.08.1, we direct the Registrar to draw up, sign and seal an order dismissing the application.
