-
For two offences of having sexual intercourse with a person under special care aged 17 years or over and under 18 years, his Honour imposed an aggregate sentence of imprisonment for 1 year, 8 months, with a non-parole period of 1 year. CaseChat Overview and Summary
The central legal issues in this appeal were whether the sentence was manifestly excessive and whether the sentencing judge had erred by failing to take into account relevant considerations and by taking into account irrelevant considerations. The court had to consider the relevant factors on sentence, the objective seriousness of the offence, the relevance of the victim's age to the objective seriousness, and the relevance of a change in the elements of the offence post-sentencing.
The High Court held that the sentence was not manifestly excessive, and that the sentencing judge had not erred in failing to take into account relevant considerations or in taking into account irrelevant considerations. The court found that the sentencing judge had considered all relevant factors and that the sentence was appropriate in the circumstances. The court also found that the change in the elements of the offence post-sentencing did not affect the relevance of the victim's age to the objective seriousness of the offence. The appeal was dismissed.
The High Court did not make any orders.
