CaseChat Overview and Summary
The primary legal issues before the court were whether the use of a low-lying bed and a coded keypad lock system constituted physical restraint under relevant federal regulatory schemes, and if these practices could be justified under the Quality of Care Principles 2014 (Cth) and the National Disability Insurance Scheme (Restrictive Practices and Behaviour Support) Rules 2018. The court needed to assess whether these restrictive practices were necessary, proportionate, and in FNX’s best interests, particularly given their cognitive impairments and the risk of harm.
The court concluded that a guardianship order was necessary and practicable for FNX’s care and welfare. The use of a low-lying bed and a coded keypad lock system were determined to be physical restraints, but the court found that these measures were justified as a last resort to prevent FNX from harming herself or others. The court emphasised the importance of obtaining FNX’s views and ensuring that any decisions regarding restrictive practices were made in accordance with a comprehensive care and services plan. The Public Advocate was appointed as the guardian to make substitute decisions regarding FNX’s medical treatment and to consent to the use of restrictive practices under specified conditions.
The court made a continuing guardianship order for a period of three years, appointing the Public Guardian as FNX’s guardian. The order includes specific functions for the guardian, such as providing consent for medical treatment and authorising restrictive practices under strict conditions. The guardian is required to take reasonable steps to understand FNX’s views and ensure that any decisions are made with their best interests in mind. The order also includes conditions for the use of restrictive practices, mandating that they be used as a last resort and in accordance with a detailed care and services plan.
