1. The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of the Australian Capital Territory (Berman AJ) which refused the applicant leave to appeal from a decision Supreme Court of the Australian Capital Territory (Kennett J).

2. The proposed appeal has no prospects of success and raises no question of law nor of general principle. The application should be refused.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
