The arguments which the applicant seeks to raise on appeal to this Court were not raised in the courts below. As a result, this Court would not have the benefit of the reasons of those courts in its consideration of the appeal. In any event, it is not apparent that the arguments to be raised by the applicant enjoy sufficient prospects of success to warrant the grant of special leave. Special leave should be refused.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application with costs.
