STATEMENT OF DECISION AND REASONS
APPLICATION FOR REVIEW
This is an application for review of a decision of a delegate of the Minister for Immigration to refuse to grant the visa applicants Temporary Business Entry (Class UC) visas under s.65 of the Migration Act 1958 (the Act).
The visa applicants applied for the visa on 28 December 2016.
At the time the visa application was lodged, Class UC contained Subclass 457. The criteria for a Subclass 457 visa are set out in Part 457 of Schedule 2 to the Migration Regulations 1994 (the Regulations). One of the criteria to be satisfied at the time of decision is cl.457.223 which requires the visa applicant to satisfy one of the alternative ‘streams’ for the visa. One of these streams is contained in cl.457.223(4) which is set out in the attachment to this decision. In the present case, specific claims have been made against cl.457.223(4) which applies to sponsorship for employment in an occupation by a standard business sponsor. No claims have been made in respect of the other alternative streams in cl.457.223.
The delegate refused to grant the visas on 8 November 2017 on the basis that cl.457.223(4)(a) was not met because the primary review applicant (‘the applicant’) was not the subject of an approved nomination.
The applicants applied for review of the primary decision on 24 November 2017 and provided a copy of the department’s decision.
The applicants were represented in relation to the review by their registered migration agent.
On 22 July 2019 the Tribunal wrote to the applicants pursuant to s.359A of the Act, inviting them to provide comments or respond, in writing, to information it considered would the reason or part of the reason for affirming the decision under review. In particular, the Tribunal raised information indicating that the review of a decision of the department not to approve a nomination in respect of the applicant made by KHOWEISS BROTHERS PTY LTD, her proposed nominator, was withdrawn on 17 July 2109. Further, there was no information…

CaseChat Overview and Summary
The Tribunal reasoned that as the review of the nomination had been withdrawn and no relevant nomination was recorded on the Department's files, the primary applicant could not satisfy cl.457.223(4)(a). Consequently, the primary applicant did not meet the primary criteria for the grant of a Subclass 457 visa. The Tribunal further noted that because the primary applicant failed to meet the primary criteria, the secondary applicant, who relied on being a member of the primary applicant's family unit, also failed to meet the secondary criteria under cl.457.321. The Tribunal found that the requirements for the standard business sponsor stream had not been met, and no claims or evidence were presented regarding other streams of cl.457.223.
The Tribunal affirmed the decision not to grant the applicants Temporary Business Entry (Class UC) visas.
