CaseChat Overview and Summary

The matter before the Tribunal was a review of the administration of an adult person's financial affairs. The adult, DFO, was subject to a previous administration order made by the Tribunal, appointing TO as administrator. However, concerns arose regarding TO's management of DFO's financial affairs, including questions about the continued operation of DFO's bank account by DFO's mother as a purported trustee. The Tribunal was required to consider whether TO had adequately managed DFO's financial affairs and whether there were grounds for appointing a new administrator. Additionally, the Tribunal had to determine if an investigation into TO's management of DFO's financial affairs was warranted.

The legal issues before the Tribunal included whether TO had properly fulfilled her role as administrator, whether there was a need for a new administrator, and whether an investigation into TO's conduct was justified. The Tribunal considered the statutory framework provided by the Guardianship and Administration Act 2000 (Qld) and the principles of good administration, including transparency, accountability, and the protection of DFO's interests. The Tribunal also examined the evidence presented regarding the management of DFO's financial affairs and the allegations against TO.

The Tribunal found that TO had not adequately managed DFO's financial affairs and that there were grounds for appointing a new administrator. The Tribunal removed TO as administrator and appointed The Public Trustee of Queensland in her place. The Tribunal also directed The Public Trustee of Queensland to investigate TO's management of DFO's financial affairs during her tenure as administrator. The Tribunal noted that if the investigation revealed any failures by TO to comply with the Guardianship and Administration Act 2000 (Qld), it would consider making a compensation order against her personally.

The Tribunal made several orders, including removing TO as administrator and appointing The Public Trustee of Queensland in her place. The Tribunal also directed The Public Trustee of Queensland to investigate TO's management of DFO's financial affairs and to provide a report to the Tribunal by 30 November 2024. The Tribunal put TO on notice that it would consider making a compensation order against her if the investigation revealed any failures to comply with the Guardianship and Administration Act 2000 (Qld). The Tribunal's orders aimed to ensure that DFO's financial affairs were properly managed and that any breaches of the statutory requirements were addressed.
